我的PD是2008九月底,485交了后,去年4月就打了指纹,现在状态仍是acceptance.
没有申请EAD,但是申请了AP(因为可能会在11月因公司商业项目短暂回国两周).现在AP
拿到手了,可是由于H1B是在9月底过期,因此在九月中提交了延期申请,迄今未批.
请教一下,在这种情况下,返美会有问题么? 是不是只要带上AP和申请H1延期的receipt
就可以入境了?

我去年也遇到过这个问题，H1B可能会有问题。以下是律师对我这个问题的回复：
With regard to consequences of traveling out of the country while H-1B
extensions are pending, please note the following:
Technically, The extensions would be considered abandoned which means USCIS
may approve only the I-129 petition but not the extension part. That means,
the only way you can regain H-1B status is by going back out of the US ,
again, and applying for H-1B status at the US Embassy abroad. Please note,
it is not out of question that USCIS may approve both the I-129 part and the
extension (probably not realizing the alien traveled out of the country).
However, a cautious approach should use the assumption that the H-1B
extension part would be considered abandoned if traveling out of the the US
during adjudication.
