1, For this EB3 downgrade, are we going to go through the whole PERM process
to get a new PERM, or are we going to just use our previous PERM approval(
EB2)?
** This is not actually a “downgrade”. Rather, it is a second I140 filing
to classify the case in EB3 so you can file your green card application
immediately. Your EB2 I140 remains valid, as does the PERM that Lam filed
for you, so neither of these need to be resubmitted. The sole purpose of
the new I140 is to enable you to file your AOS immediately since the EB3
priority dates have moved ahead of EB2 for green card processing.
2, If we use the old PERM approval, and File 140 and 485 together, are we
able to use premium service for make the process faster?
** Yes, and we plan to do that.
3, Is it possible to cause any issue for such downgrade? Is it possible to
get rejected? If so, what kind of effect can it have? Will my old PERM(EB2)
got void or my priority data got void?
** No. USCIS authorizes employers to submit multiple I140 petitions in
situations like this.
