is this gonna be a difficult problem?
So after the audit in which we submitted the required materials, the DOL has
just denied the PERM case, but I believe it to be an error. I have attached
it for you to review. There are a series of cases recently, where the DOL
has gone back and forth about how to handle the form itself and alleged “
errors” in the form. In this case, we had an audit, whereby we submitted
the required recruitment, including the dates of the national journal
article, etc. It is my opinion that this denial falls under the “
governmental clear error” doctrine of motions to reconsider which they have
been deciding in about 60-90 days. I will submit that request this week and
get back to you with the results. I must say that the DOL has in the last
year or so become increasingly more and more difficult to work with. I will
let you know what we hear back from them.
