我去年12月提交了去新东家的H1B transfer, 当时我的PD还没Current，现在已经
current了。
我的问题是：因为我的140早就批了，尽管我H1B已经用完6年，H1B transfer批3年没问
题吧？ PD current后只能延期1年是说提交I129时PD已经Current的情况吧？
另一个问题是：
不在老公司提交485没啥影响吧？ 去了新东家马上可以开始PERM 140. 考古得出的结论
是已经交了H1B transfer就不应该在老东家继续提交485了，这结论也没错吧？ 反正我
也不想在老东家继续干足180天

进了新东家，办完PERM后，如果老PD仍然current, 可以同时提交新140和485吗？还是
必须等新140批准以后才能找回老PD？然后才能485?

AC21还有这么一条： PD current一年之内如果没有交485,就不能再做H1B超过6年的延
期了。
那么问题是，去了新公司还要重新PERM 140， 假设PERM批准之前又要H1B延期，岂不是
必然会被拒，因为PD current超过一年,因为PERM没批准，所以没法提交485。

确实忽视了这一条。
不过这一条几乎没人遇到是有原因的。 1）这个一年期限每次排期倒退的时候都会
reset，所以除非你是极老的PD，以至于每次即使倒退你都还current，不然不会碰上这
个问题。
2） 如果不申请绿卡的原因是超出alien控制的，那这个limit是可以excuse的。原PERM
和140的申请者不再支持这个alien申绿卡就是很明显的超出alien控制的。
NIW可以沿用PERM-140的PD。
NIW具体要求我没有研究。

不过这一条几乎没人遇到是有原因的。 1）这个一年期限每次排期倒退的时候都会

个问题。

PD连续Current超过一年，延H1B才需要解释为什么在过去一年里没交485，而换工作、
正在重新申请PERM等都是USCIS可以接受的理由，不会导致H1B延期申请被拒。

请问这个连续current超过一年，具体到需要连续几个月呢？我的排期很老，curernt超
过一年很多了，不过去年8月曾经有过次排期倒退，那时候current不到一年。
另外这种情况申请h1b transfer的时候需要特意说明吗？还是等rfe？

当然是连续current 12个月。12个月内排期倒退过使你那个PD不再current，那这12个
月的clock就reset了，所以那个条款不适用你，正常transfer/延期就行。

哦哦， 我有点明白什么意思了。那刚好最近两年每次7，8月左右倒退导致我的pd不
current了，那我其实不算连续current 12个月了。
