请教O-1签证递交I-140会影响回国返签签证吗# Immigration - 落地生根

DS-160表有一项：“Has anyone ever filed an immigrant petition on your behalf
with the United States Citizenship and Immigration Services?”
I-140属Immigrangt Petition for Alien Worker，若递交，即使尚未批准，该答YES。
不知道对回国返签签证是否有影响，想走之前递交，有些犹豫。原来的理解是I-485
pending状态下若在境外申请O-1视为I-485的自动放弃。

我的140批准后，回国签了h-1b，毫无影响

多谢回答。H1是 dual intent, O-1还有争议。

I guess nobody will know more than what has been written there. I personally
cannot agree more with pjiang's analysis. Therefore there would be no
problem for your O-1 visa if you had 140 or 485, or if you enter with O-1
visa if you have or had I-140 pending or approved. However entering on O-1
with 485 pending will jeopardizing your 485.
