和大家简单说下情况，16年抽中的H1B，现在换工作，新雇主的移民律师问我要CAP-GAP
的I-20.
然而16年我并没有在gap期问学校要CAP-GAP的I-20。
会影响新雇主的H1B申请吗？现在问学校要还来得及吗？
大家有人有相似的经验吗？

16年你的F-1是什么时候到期的，以及到10月1号的gap期间有合法身份吗？
现在问学校要肯定是来不及的，如果gap期间是不合法的留在美国，可能是有影响的吧

cap-gap extension is automatic when you are ELIGIBLE. cap-gap I-20 is not
required. Just show the I-20 (D/S with OPT endorsement), EAD (expired after
your I-129 RD) and your I-129 capped-h1B approval notice(with start date
Oct 1, 2016) to prove that your were eligible for cap-gap in 2016.

身份是合法的，因为opt是16年七月份过期，自动extension. 只是不知道没有cap gap
i20会不会影响到新的工作h1b petition？
