Short sale的房子,我是buyer. '先按时间顺序交代一下:
11/15/12, bank short sale approval
11/21/12, seller informed the buyer of the approval
12/26/12, according to buyer's agent, this is the date by contract the
escrow needs to close
01/11/13, bank approval deadline.
现在我是不介意seller住到过完圣诞节,但是我希望年底前close, for tax purpose.
Seller想到1月初再搬,(之前问我可否rent back,我拒绝了),
按照合同,我的loan圣诞节前可以close, 我有没有权利要求他们在年底前搬家?

我倒也不是一定要年底close,大过节的不想别人家不好过,just wanna know.

不少见啊。
Seller如果把住在那到一月作为一个条件的话,你们也接受的话,那没啥好说的。
否则,you are at the mercy of the bank & seller.
That's why you take risks buying short sale ... which is cheaper.

A colleague here in SoCal had a transaction last year where a week AFTER
closing the former owner (seller) decided they were "not moving" - EVER. It
took the new First Time Homeowners more than 7 months to get them out
through the eviction process. These First Time Homeowners could not carry
both their Rent and their new mortgage so they had to move in with friends
while they paid the mortgage for the prior owner to live in their house.
We have to be really careful ! It's getting really crazy out there .....
