昨天收到一个的email,背景是他从我这里买了东西,USPS邮寄去MT,tracking到了NY就设
有再更新,我的店里Policy明确写了除非他额外付保险,否则不负责postal loss or
damage的,他当初是拒绝加保险的:
This is the email I received:
I have been dealing with the post office in an effort to track down my
package. They have escalated my case to the Department of Consumer Affairs.
They have been working with the post office to track down the package that
you mailed to me. The last trace they had of it was in NY which is where it
was last scanned. They have no idea where the package is now and assume it’
s lost in a mail bag or in some sorting equipment. They have no idea if the
package will ever get to me.
The gal at the Dept. of Consumer Affairs told me to get a refund or have you
ship me more product. I told her you were unwilling to do so and she told
me that it’s legally the seller’s responsibility to refund or reship the
product if it doesn’t reach me. She said that if I purchase something and
don’t receive the product, that it’s considered mail fraud because my
money was taken, I didn’t receive the product, and the US Postal system was
used -- even though the post office is the one who lost the package. That
hardly seems fair, but that’s a seller’s legal responsibility. She said I
should absolutely not have to repurchase the product to receive what I
already purchased. She also said I should file a mail theft report against
you. Please understand that I have no intention of filing a mail theft
report against you. I truly feel that you honestly weren’t aware of your
legal obligations as a seller. I also specifically asked if insurance is for
the seller or buyer’s protection, and she said it’s only for the seller’
s benefit because it’s their responsibility to make sure the package gets
to the buyer. I encourage you to contact the Dept. of Consumer Affairs to
verify what I’ve told you. Their number is (605) 333-2646. I was assigned a
case number that’s attached to the tracking number. If you want to
reference the case number, it’s CAxxxxxxx.
I'm that I’m submitting this information to you only so you may know your
legal obligations as a seller. As a seller I, too, fall under the same
obligations. Please either issue a refund or reshipment the product.
