10/22, 140 NOID response received.
10/28/2013, 140 approve.
EB1B, must use company lawyer, can’t PP, can’t fill 485 before 140
approval. All the documents were given to lawyer in October 2012, included
petition letter (claimed authorship, judge and contribution). I believed the
lawyer can send them out after write her name. Then they used 3 months made
another draft, claimed citation first! List some of my background while
initial submission.
7 journal English papers, 4 first author, 3 second author, 2 first author
paper IF > 8.
Citation > 40, independent ~ 30, 15 countries and 26 institutes / national
lab, also included some companies such as DuPont, Dow, Sigma.
One project with Air products was already commercialized. The lawyer just
mentioned the project in 2 sentences.
Review 37 drafts from 8 journals, IF 2 – 5.
8 reference letters, 1 dependent PhD advisor (US), 7 independent: 1 US, 2 UK
, 2 Germany, 1 Spain, 1 Korea (editor of journal), all of them are full
professor, some are department lead or titled professor.
Edited 17 Chinese books, > 10 million words. One used as graduate textbook,
2 got 优秀图书1st and 2nd prize. All those books relative materials were
delete by lawyer.
Argued with lawyer, give many suggestions according to their draft, finally
they change nothing.
Asked the lawyer made 1st and 2nd service request after 7 months of 140 RD.
Then got NOID for citation and contribution on 10/08.
The worst thing was the lawyer let me know the NOID after 19 days of the
NOID issued. I think all the people know the tight schedule to response in
30 days. Now I have 10 days to prepare all things for the lawyer, they had
no any suggestion, just strict with all my supporting information should
before my initial submission date and need hand in the documents on later
than 10/18.
I have to say that 雪中送炭 always better than锦上添花. I strong support
from friends, they help me review RL drafts, encouraged me. Also get support
from MITBBS friend such as dayup, flyfluhugo, bigbigbee. Of course, from my
wife, she kept me calm down without being crazy.
I think to prepare NOID response, the most important thing is insist, if you
give up, the lawyer are glad to do that, especially the company lawyer, I
can felt that, they already got the money, the response means additional
jobs to them.
Finally I got 7 RL, one for my commercialized project, one for my edited
books, both 2 RL were from industry. 1 from Brazil, 1 from Mexico, 1 from
department head of US university and 1 from US national lab. I also ask the
Korean professor wrote letter again to emphasize my job as reviewer.
As the time I got NOID, the review 47 drafts for 11 journals from 18
countries.
Citation > 60. 2 first author papers citations are > 2 times of the average
citations of No. 1 journal in my field.
Papers were cited by 3 more companies, such as Intel, AMAT and Lam.
And I insisted including all covers and page with my name from the books I
edited.
Finally the lawyer use most of the draft of made for the response, I think
the reason is that they don’t have time make another one, HeHe. You know
the lawyer even told when I got yhr NOID, the IO actually already made the
final decision.
Then the lawyer submitted all the documents on 10/21, I just cross my
fingers and still get encourage from friends such as dayup. Then I received
the approved message on Monday morning 7:30AM.
I don’t think above things is real helpful for the special case, but I want
to transfer one message: it is sad to get NOID, but remember at least you
still have opportunity to claim for yourself, please don’t give up. 用一句
俗话来说：就算是颗臭子， 也要打三枪。Let beat IOs together, I agree I am not
as good as some EB1A people, but I definitely good enough for 1B. Believe
yourselves. 象炊事班的故事里说的： 你不是一般人，你能行。
