今天公司有新的产品出来，昨天闲着没事闹的，给小组里的人发了封信（十多个人）
，问大家有没有试过新产品，觉得今天股票会怎么走，因为我有一些share 要卖。不
过没人回。
今天一同事过来，提醒我不要在email 里问类似的信息，因为可能会牵涉到insider
trading的问题。我顿时醒悟。现在很担心！！！请问我这到底牵涉不牵涉到insider
trading?如果是我该怎么做？当然今天我没有买卖任何股票。

那到底算不算insider trading啊？对了我并没有买卖股票今天。

Of course, even you don't have direct relationship of the product, you are
still subject to inside trading rules. Once you are with the company, all
information regarding the company, except from anything publicly
known, can not be used to trade. Even you overhead news in the restroom are
enough send you to jail if prosecutor can prove you used this to trigger
your trade.

You are only allow to trade on public known information. (有人问你就照实说 -
-nah!!) -- if that's not public knowledge, you are going to jail.
You need to have prosecutor to prove that you traded on private knowledge --
that's the key. And you can not destroy documents/communication related to
your trade, or you are committing "obstruction of justice", which prosecutor
will seek this alternative if they launch investigation (for example:
Martha Stwart).

From your email, please don't touch your stock for at least 30 days! or you
are in trouble. If your colleague send it to SEC and you have trades
following, your life is ruined.

Good, don't act upon inside information. Even if you can, you can not
leave any proof you did act upon it. Your email is a proof that you have
this intention.
You can talk if no-one records ...

No, let it be, and let it die down. It is serious though.
Lots of company has this kind of "RED" flag training. BTW, if you didn't
follow up with trade, there is nothing done wrong yet.

Tell them you don't know, neither you have any intent to trade upon it (sit
on your hands on this stock!!).

没多大事你几个月别trade公司股票就是了 sec fbi exectuvive 的inside trade都抓
不过来还管你几千块的espp？

那位猪博士说得有点太吓人了
就我的经验来说，你如果是insider trading list上的人，你的ESPP券商的程序会自动
阻止你在block window期间下单的
你做的不太好的事情就是用email来公开问这个事情，还涉及了新产品
其实也没什么大不了的事情，但你防着点就这个季度别动自己公司的股票

每个季度的espp到手后都立刻卖掉，这个季度突然不卖了，有问题吗？

唉，真是一点警觉性都没有啊。在米国混最重要的就是不要留写下来的证据，居然在
email里头公开问。

No I have ESPP from last two vests. My selling is not very regular.
Sometimes I sell right away, sometimes I keep it for a while before next
vest. I didn't really pay too much attention to it before.
