公司11/19 terminated my job.
公司现在还没有上报移民局撤销我的H1B.
我已申请到1月初开学的I-20,如果现在递交change of status，据说处理时间要两个
月。
如果，我在接下来的1-2个月时间找到工作，因为H1B-F1 pengding,我就无法工作.
等到F1批准后，我又得立即转回H1,大家觉得这样做可取吗？还是，现在不转学生身份
，集中精力找工作，找到后做H1B transfer. 而且我不介意回国再签H1B出来。
想听听大家的见解，谢谢！

I doubt SO will go to EB3 this year.
Some people missed the 2007 boat, the new demand plus the existing demand
will be close to the SO this year.
They have to open the gate in this summer, otherwise SO will go to EB3 next
year.

I heard that if there is still a lot number unused for EB2 before the
deadline, they will use some for EB3.
So whether there is any SO goes to EB3 is not only decided by the EB2 number
before 07/07, but also depends on the how fast the USCIS processes the EB2
485 cases.

Some corrections and thoughts:
Currently there are 21k pending cases (excluding the cases before 10/15/2006
).
I estimate there are around 6k new demand before 2007/07 because some
people missed the 2007 event.Totally there are 27k demand before 2007/07.
However, the new demand cannot be approved in 3 months, so the real demand (pre-processed cases)will be 21k. The available visa numbers will be around 24k-25k.
It is possible that they will move 3-4k to EB3.
If only 80% of the 21k EB2 can be approved, 6k visas will go to EB3 this year.
In a word, they must open gate for EB2 in this summer!

Maybe their numbers will be close.
This summer will be a huge summer for EB2. It looks like that the visa
numbers will be bigger than the "pre-adjusted cases".
I think the SO will clear all the pending cases in this summer. They have no
choice, but to open the gate in this summer.
People, stay tuned and get ready for 485.

It is pretty clear PWMB may not use this year's SO because of processing
time. All unused SO will go to EB3I. Sorry, the reality is ugly.

你这个PWMB是啥缩写？是pre-adjusted cases的吗？就是那些大潮中已经交了485的。
如果是的话，印度的EB3应该也是 "pre-adjusted cases, 那为啥没时间批EB2的，有时
间批EB3的？
如果你这个缩写指的错过大潮的新交的485,来不及用SO了，倒是很有道理。

yes, that's why I am worrying about this summer.
PWMB will not be approved until next year.
Currently only 21k pending C/I EB2 (exclude PD < 10/15/2006), the spill over
is estimated 24k-25k for now.
The 21k pending C/I EB2 will not be approved 100% and the Spillover may go
to EB3 (3k-9k).
The DOS MUST open gate in this summer, otherwise they will waste BIG number
next year!

如果EB2没有current，凭哪条法律他们能把SO给EB3呢？这样是违法的，我们得和USCIS

首先这都是没有必要讨论的问题。今年的剩余最多处理到２００７年７月，８月左右。
不可能再多了。
就算名额分到中国EB３，那也是好事。大家还是多想办法怎么让O把闸门打大点，多让
后面的人交485。

我知道老印在搞campaine,他们的EB3人数众多，声势远大于EB2，所以我担心的是USCIS
就要大手一挥，把EB2限制在2007某个月份，不肯把EB2的排期按照SO放开，然后声称多
出来的SO，为了“避免浪费”，只能分给EB3（当然主要是EB3I，老中EB3太少了，老中
主要是EB2).
这个SO不能流向EB3的问题，不是EB2，EB3之争，而是EB的中印之争。

Are you kidding me? Why would we call for "Recapture" if they haven't wasted
our visa number in the past 10 years? we will be current for now whithout
their wasting visa numbers.
