老婆是F1签证，我们付了部分学费，现在想申请这部分学费的deductible。
学校这么回复的
“
The 1098T form is for resident & Citizen students only. Besides you have a
tuition waiver and did not pay for any tuition, so you will not qualify for
the tax credit.
The only exception we can request a 1098T form for a foreign student is they
are in the US for more than 5 years, they are filing a tax return as a
resident alien.
”

Yes, only if you or your wife is resident alien. Otherwise, 1098T is of no
use.
In the case, you can argue with the school saying spouse is resident alien
and you want to file a joint return to treat the non-resident as resident as
well.

Absolutely!
I am sure they abuse H1b system. I read on IV forum that someone said his
friend just cook for others after losing job in 2001/2002 and still got GC.

any many Indian are working in Inida and waiting for EB2.............
They can find a fake company and sponsor the EB2, then wait in India until

去年那个向老印征收H/L签证ICC税去抓老墨的法案三天之内通过
就是在这种大环境下出台的
其实老美还是很痛恨FRAUD的
ICC作假问题 在07大潮之后的国会听证会上就已经涉及了
他们被盯上已经不是一天两天了
以后估计很难再像08年那样
每年搬运十几万老印过来了
