我的情况是这样的：我和我的丈夫于2009.8月来到美国做博士后，都持有J1Visa，并且
都受回国居住两年的限制。我现在的DS2019将于07/19/2011过期，但由于一些原因，现
在的老板不能和我续签合同了。我就想转成J2，因为我丈夫会继续renew他的DS2019表
的（他现在的DS2019是08/31/2011到期，他老板准备和他续签）。现在我有以下几个问
题不清楚：
1. 像我这样的情况，是否能在美国从J1转成J2？还是必须回国重新申请J2签证，
再回来？
2. 如果必须回国重新签证的话，我在美国的合法身份什么时候过期（是以我现在
的J1到期时间为准？还是以我丈夫的J1到期时间为准）？
3. 如果我回国申请J2签证的话，会不会受回国居住两年的限制？会不会就没有办
法回来美国了？
由于时间紧迫心里很慌乱不知各位是否有类似经验。多谢！

老印申请绿卡也太多了吧？
相比之下，中国人数量为什么差这么多？从其他途径搞到绿卡了？很多回国了？来美
人数相比太少？雇主更愿意雇用老印？比如这个公司cognizant technology solutions
,2010年sponser1005个Perm其中994个老印，0个中国人。怎么证明这个公司hire的时候
对所有求职者都是公平的？

1. Sections 30.3(b)(2) and 30.3(c)(7) in the USCIS
Adjudicator's Field Manual contains a specific but
obscure exception to 8 CFR 248.2(a)(3) and 248.2(a)(4),
so a direct change of status between J-1 and J-2 is
allowed.
However, reality has shown that not all USCIS
officers are familiar with this exception, and some
I-539 applications to change statuses between J-1 and
J-2 are incorrectly denied under 8 CFR 248.2(a)(3) ir
248.2(a)(4).
If you plan to file an I-539, you should prepare a
brief (or hire a lawyer to prepare one) citing the
above sections of the USCIS AFM and submit the brief
along with the I-539 to ensure that your case is not
denied.

2. If you do not file the I-539 to change to J-2,
then you can only stay in the U.S. until August 18
(the 30-day grace period for J-1).
3. It doesn't matter how you become J-2 (by filing
I-539 or getting a J-2 visa outside the U.S.), you
will be subject to both your two-year obligation
and your husband's two-year obligation, so a total
of four years, unless waived. See the above AFM,
Section 30.3(c)(7)(B).
This does not prevent you from coming to the U.S.
in J-2 status or other nonimmigrant statuses; it
prevents you from coming back in H-1B/H-4 status
or other statuses that might lead toward immigrant
status.
