I am on H4 visa now. My future employer is planning to process my H1B
visa recently. I will start working from late June 2012.
Can I go back China with my H4 while my H1b is
processing? Do I have the risk of stucking in China?

COS 的时候不能离开米国,否则 COS 申请马上作废。
可以等你 H4 签证回美国在　file, COS.
可以让你公司申请 H1B,然后你拿H1B approval 在中国签 H1B 回来。
总之　change of status 没批准的时候不能离境，否则就不叫　COS 了。

借宝地问一个类似问题吧:
我和我ld都是h1,都交了４８５,我是主申请人,应该会马上收到ap.但是我ld会在４月１
０被layoff(她的h1b虽然到９月底),因为虽然是交了４８５,但是据说为了保险,最好还
是给她换成h4.所以我想把她的h4申请最近交上去.　但是我们想５月份利用ap回去一趟
,那按照你说的她的cos就作废了,我根本就没必要给她申请h4了.
我想问一下:
可以等她从国内回来申请h4吗?　如果六月份回来,那４月到６月有两个月的gap,交了４
８５应该是合法的,但是那个时候申请h4还可以吗?

5月份你们都准备用 AP 回去？那回来的时候你的 H1B 也失效了。你可以在申请转
回H1B 的时候把你老婆也转回 H4.

用AP应该不影响h1b的吧

用了 AP 回来就不是 H1B 身份了，不过可以申请再转成 H1B.

最后的结论在26楼：
It is tricky and here is the best theory I learned:
1) After using AP, your status becomes parolee and no longer H1b. But the
work authorization, which is approved by your original H1b application, is
still there as long as your work for the same employer. Therefore your DON'T
need to use the EAD card and can extend your H1b with the same employer.
When you apply an extension, you file a I-129 to adjust your status back to
H1b.
2) For H1b transfer, it is more tricky. But you can do it by first filing an
amendment to change your status from parolee back to H1b. It is doable.
Then you can apply for transfer as usual.
I know it can be done this way, but you need a good lawyer who knows what he
's doing.

问题是他可以不申请H1B,可是他想给他老婆办H4 就没可能了。

那如果用了ap后,万一４８５出问题被据,还可以用h1b吗?
我以前问过版上的一个大律师,他根本不懂.

本来 H4 就是挂靠 H1 的，要是 H1 有什么问题，H4 也跟着失效，我觉得没必要。

但h1b layoff只有10天缓冲，之后就算没身份。不过能用AP回来，并且485顺利的话，
在家呆着或许也没事?!
