H1B lay off , changed to B2, found a job...# EB23 - 劳工卡

Hi, I am using my roommate's laptop that does not support Chinese Character
typing, I will type my question in English.
I was on H1B and got laid off in February 2012, my H1b still has 30 months
to go. I changed my visa to B2 visa so that I can still stay in US. My B2
visa approved and will expire in Mid-August. I have planned to return home
in mid August before my visa expires.
However, I recently found a job, but have not received the official offer
yet. The official offer will come next week, but I have to leave US in mid-
August and come back after getting my new visa. Since I am leaving in Mid-
August, all the immigration paper work will not be able to complete before I
leave. I am not sure how will my H1b processed. I am guessing the new
company still need to apply my H1b through USCIS although I am not
physically in US? Will my B2 visa affect my H1b visa application? Will I
get rejected when I go to the embassy for my H1B visa stamping?
Anyone has experience or know anything about this? Please help to provide
suggestion or answer. Thank you very much.

你不在美国境内,仍然可以让公司帮你申请h1b。。。让他们用premium process,然后
把批准件邮寄给你,然后你去中国的美国大使馆申请签证

Thank you. So, B2 visa should not affect the process?

I dont think that your B2 visa is ever gonna affect your H1B visa
application as long as you get your I797 Approval notice, besides, H1B is a
dual-intent visa, it can not be denied due to your immigration purpose
although you have shown such a strong will to stay in the States during the
process of changing from H1B to B2.
