tell them, not 3 year work experience it's 3 year research or teaching experience PHD research experience can be counted, but you'd better prove your PHD research is outstanding and get international acclaim
I think it totally depends on the policy of each school. I don't think it is something you can personally fight or argue with it. For example, I know school A definitely requires you have three years working experience, no matter in this school or the others. I know school B doesn't care at all, as long as your PI agrees. So I think it all depends on school. The rule of USCIS regarding the three year requirement is another issue.
