I have a few questions about my current status 1) my employment was terminated on Oct 25th 2013 2) Then I filed a COS on H1B to F1 on Oct 10th 2013, but today Dec 19th, 2013, I was noticed that my I539 case has been rejected by checking online status 3) However, my second employer has filed a new H1B for me on Dec 11th 2013 on premium process service. So my questions are 1) Can I still stay in US, waiting for my new H1B application result coming out? Or I have to leave US for no reason? If I have to leave US, why? 2) If I have to go home country for a new H1B visa, what is possibility that I would be approved? 3) I have checked my online case status before and after me, they are all still in the process of initial review. Is it possible that they deny my H1B to F1 case, coz they received my new H1B application?

If your last day is Oct 25, what is the reason you want to start COS earlier on Oct 10? If you are still here now, your first two questions doesn't matter any more, right? Because your H1B-F1 was rejected, you are out of status from Oct 25. When you filed your new H1B status on Dec 11, did you tell the company's lawyer you had a H1B-F1 case? For your 3rd question, it is yes or no. Anyway, you have a period of out-of- status. So, your new H1b could be (i) directly approved; (ii) approved on activation; or (iii) RFE. I feel (i) is most likely. You will soon find out, good luck.

1) coz before Oct 25, I was still under H1B, so I could do COS, from H1B to F1. And I got my new offer on Nov 4th 2013 2) yes, I did tell them about that. And they have that case receipt. 3) why there are two cases here (i) directly approved; (ii) approved on visa interview. It is (ii) approved on activation in the someone's reply before. since you have a gap. But it is very likely you get (i) directly approved since the gap is short.
