降级140公司已准备好可以随时提交
485,765,131大概4月初可以提交
我是主申请人，老公是dependent，他在4月中旬需要回国两个半月。
这样的话是等他回来后再提交485还是现在交
就怕等他回来，eb3倒退了

你们现在是什么身份？h/l，可以，到时候继续签现在的visa回来。f/j之类的，交了

H可以。我上周刚从中国回来。先交了485，2个月后回中国重新申请h1签证。申签证第
二天收到消息说ap批了。最后用h签证入境。一切顺利

就是说H签证交完485之后，拿到AP之前也可以随时出入美国？
我之前一直觉得必须呆到拿到AP才能走

大多数人看了 I-131 的 instruction doc：
* http://www.uscis.gov/sites/default/files/files/form/i-131instr.pdf
* Page 6, Part.2.Who May File Form I-131? 3.d, it states: “If you depart
from the United States before the Advance Parole Document is issued, your
application will be considered abandoned.”
以为拿到 AP 之前都不能出国，但是其实这是指的不能有 dual intent 的签证，证明
看 USCIS 给 ALIA 的答复：
* USCIS – AILA Liaison Committee Agenda (4/2/08)
* http://www.uscis.gov/sites/default/files/files/nativedocuments/AILA_2Apr08.pdf
* Page 16, ADDENDUM V, “Yes, we confirm that that abandonment of a pending
advance parole application does not occur if the foreign national is
otherwise authorized to depart and return because the foreign national has
an 1-485 pending and is readmitted as an H-1, H-4, L-1, L-2, K-3, K-4, V-1,
V-2, or V-3.”
只要 H1B/H4 在 AP 批下来以后还是以有效的非移民签证身份进来，不视为放弃 AP
申请。这是为什么严格意义来讲 AP 不能寄回国然后用来进入美国的原因。不过 CBP
有时候不仔细也会放你进来。（具体分析看 pjiang 的 blog）
而对于绿卡 I-485 来说没有任何限制，交了就可以离开，可以寄回国，然后拿着进来。

不过有些情况我不是很理解
特别是拿h-4的副申请人拿到ap前回国的
万一主申请人绿了，副申请人也没法用h-4回来了吧
