上年9月filed的EB2 PERM, 今天certified，今年9.30号H1B六年到期，希望I-140顺利。
1. 律师建议premium processing, PERM I-140是不是也像 EB1B的I-140那样，PP比不
PP容易被拒？
2. 看了版上的讨论，迷惑该走EB2的I-140，还是EB3的I-140, 还是走两个I-140?
3. I-140现在还需要准备以前雇主的employment verification letters吗？

PERM I-140很少有拒的
PP可能会增加RFE的几率
但是RFE都很容易解决
只要你自己满足PERM上职位要求，公司也有能力支付你薪水就行了

满足PERM上职位要求是不是需要以前所有雇主的employment verification letters来
证明呀？
在一个大学做staff, 支付薪水应该没有问题.

File as EB2 比较保险。可以降，也直接file 2类485

以前雇主的工作证明还有点麻烦，离开的时候，和公司的manager关系不怎么样，有没
有啥办法能避开以前的manager,还能拿到工作证明?

像这样的过程，一般要多长时间？
如果在9.30号前没有结果，是不是作为 PERM pending一年以上，还可以延长一年H1B?

PERM被拒了怎么办？
PERM如果因为政府失误原因(如工作人员搞错prevailing wage有效期)被拒可以提请
request for reconsideration这种申请处理比较快，通常会在2、3个月内进行答复。
如果request for reconsideration失败或者因为雇主自身出现的可改正的错误而导致
PERM被拒，则需进行上诉(appeal)。上诉可能需要花费数年时间，且结果很难预期。因
此如果PERM被拒最好尽快重新开始新的PERM申请过程，防止出现拖了多年最终appeal还
是被拒的情况。当然如果appeal成功，则可保留原有优先日。
不过你的情况比较复杂，H-1b还有几个月到期，如果request for reconsideration和
appeal都失败的话，PERM重递，你得靠recapture没用掉的时间或者转身份或者离境来
凑时间了

在appeal等待期间，还能以PERM pending more than one year为理由，延长一年H1B吗？
H1B可以recapture8个月的时间到明年四月，可能PERM重新递交，是比较靠谱的。

看到老印网站上这样一句话，好像appeal期间是可以extend H1B一年的？
They have appealed against the decision, but it usually takes longer time
than submitting a fresh application. But appeal is needed to keep the perm
in pending status for more than an year and subsequently extend my H1B visa
for another year.

Perm不经过audit直接被拒的情况，拒你的CO不能拒绝申请公司提出motion for
reconsideration or request for review，视同audit过程补充材料。
尽快管律师要拒信回复和申请表附件，看清申诉截止时间，一般拒信邮寄日一个月。根
据拒信所述原因逐条申诉。mtr受理分两队，government error & regular, 目前在1个
月左右，具体等待时间网上有。goverment error胜诉机会大些。认真读拒信，找CO可
能的错误。
mtr后是balca，过程旷日持久，一般公司拖不起。balca与perm refile就是鱼和熊掌的
关系，你要选择。当然perm refile需要pending 一年以上才能延h1,对你帮助不大。
现在准备好mtr材料比较重要。一个月内搞定，比audit同学还快半年。

在打广告时，job requirement experience 只有两个选项
1. minimal 0-4 years
2. minimal 4-7 years
当时律师说我有5年以上经验，可以选2，这样可以多过滤掉一些候选人。

你自己也没有仔细的审阅ETA 9089
ETA 9089上的requirement很清楚，是多少个月的工作经验
我从来没听说过什么0-4 4-7的选项
工作要求的一个忌讳是量体裁衣，针对applicant提要求是会出问题的
你这里更严重的问题是看起来你再加入这家公司之前的工作经验是不能计入的
你明确一下吧，ETA-9089上要求的工作经验是几年，你加入公司前有几年经验
如果这条不满足的话，就难怪会不经过audit直接拒掉了

雇主登陆填入雇主的信息，剩下的律师来填
关于工作经验是的，你在现在这家单位的经验是不算的
如果ETA-9089上H 6-A他填的是84的话，你这个我觉得没什么机会了

对，在现在单位的工作经验不能算。
如果（比方）job2 的公司被现在公司收购，也最好不要算job2 的经验。

给那个律师发5个电子邮件，能回一个就不错了，在递交俺的PERM后三个多月，就跳槽
走了。
现在负责appeal的是一个新律师，要尽快和他确认一下，ETA-9089上H 6-A填的是84，
还是 48-84？
国内的工作经验能不能算上，凑够84个月？
如果填的48-84，是不是让部门出一个书面文档，证明这个职位有48个月工作经验的
candidates，都是适合考虑的候选人?

不知道你们公司好不好说话, 有没有可能让公司给你换或升个title， 这样就是新
occupation with 不同job description, 要 more than 50% different from the old
one.
这样你可以一边appeal,一边申请新的PERM， 同时你在这个公司的经验也可以用上。

还是有点喜欢现在这个组，不想离开，以前跳过几次，有对比，这个组工作比较身心舒
畅。
俺是男的，老婆有个批准的NIW, PD是12年5月，现在在办EB1B,希望两个月内能递交。
让律师去request of reconsideration, 两个月后被拒，自动转appeal, 9.30前H1B
recapture 8个月到明年四月，这个时候老婆的EB1B应该有结果，如果失败，俺的H1B可
以再延期一年，批准后，可以withdrawn appeal, 然后要求从新递PERM.
最坏的就是回国一年，然后再回来，又有6年H1B,就是家里两个小孩太小，要一年见不
到爸爸了。
唉，生活不容易。

既然这样，我觉得重点还是放在你家ld EB1B上，交上去说不定很快就批了，这些就都
不是事儿了。

刚和老板一起见了新律师。
老律师在ETA-9089上H 6-A填的是84个月。
新律师的方案是走request of reconsideration，并且知道会拒，转appeal, 让这个
PERM pending，用来延长H1B，并且现在可以马上递交H1B extension, recapture 8个
月到明年4月。
同时换个job description, 马上从新做PERM,走EB3,因为俺老婆已经有个NIW approved
,走EB2没有意义了。
不同的律师真的不同，需要自己感觉靠谱不靠谱。
