no, unless it is EB5, but then again, any visa can file EB5.
you need to have a current H1B to file any kind of EB1, 2, or 3. H1B is a
dual intent visa, while H4 is just the one who is ONLY here because of
taking care of the primary H1B visa holder.

EB2 NIW and EB1A are also ok to do, as long as you can establish your
future employment after green card.

既然是EB类，批485的时候当然可能被RFE到EVL from intended permanent employer

you need find a future credible employer, who will 100% cooperate with you
when you need EVL.
if you don't get RFE, then you are all good, otherwise you'll be screwed
without an employer
