Sorry I have to type in English
What SHOULD I do??? My 485 was filed based on my approved EB3-140 downgrade
but my 485 receipts showed the EB2 category. Not sure what caused the
error. My EB3-485 should be current now but EB2 has never been current.
I got the following message from the Congressional Inquiry:
U.S. Citizenship and Immigration Services (USCIS) records confirm there are
currently no visas available to process your constituents’ I-485
applications. USCIS records show your constituent is an employment-based
second preference (EB-2) visa applicant with a priority date of May 10, 2010
. His priority date is later than the cut-off listed on the visa bulletin
for their preference. Please have your constituent refer to the website www.
travel.state.gov/visa or you may call the Department of State automated visa
information line at (202) 663-1541 to receive current visa bulletin
information.

Yes, my company's own lawyer said this in December:I believe you have
already discussed with Jeff. USCIS already has your petition queued for
adjudication as your priority date becomes current. We will let USCIS know
that your priority date is current, but this will not typically result in
faster adjudication. Additionally, we will let USCIS know that the wrong
category was listed but they typically do not take action based on these
notes (the officer usually addresses these issues through a request for
evidence if needed). We will keep you posted.

We are on the same boat. My EB2 PD is 5/10, also did downgrade.
I did SR online, got response in 10 days, which said my case was pending.
Sent email to [email protected]
/* */ to request more info, got
reponse in 10 days. The email was saying the exactly same as what you got. I
replied the email to provide more info of my EB3 I-140, like case number
and so on. This time I got response in half hour. The email said "Your file
is currently being sent to an officer for review".
You may try to email or call T2, or Infopass to get the correct info.
Sometimes, their responses may be wrong, since they may not do a careful
research.

Yes, my I-485 receipt under the PREFERENCE CLASSIFICATION is Employment
Based 2nd. That was wrong because my EB-2 never became current.

NO, I didn't. My company's lawyer is very conservative. SO I filed my 140-
EB3 downgrading PP first in April and got it approved and then file my I-485
in May.

我的140上 Notice type 下面有一行section: Professional, Sec.203(b)(3)(a)(ii),
但是485上Section: Adjustment as direct beneficiary of immigrant petition.
没有Sec.203(b)(3)(a)(ii). 这正常吗？

You may push your lawyer to do something, He might make mistakes. As you
said your EB2 PD is never current. How can USCIS accept your I-485 as EB2.

我说的是485的receipt notice。 140的receipt notice 和approval notice都有EB3类
别。非常感谢。

The receipt notice for my I-140 based on EB3 is section: Professional, Sec.
203(b)(3)(a)(ii), which should be EB3.
The receipt notice of my I-485 has Preference Classification below the "
Received Date," and between the "Priority Date" and the "Date of Birth."
I hope that helps.

Just did a service request based on typograhical error and was told the
excepted response date is January 30, 2015.
Cross fingers the EB3 won't retrogress.
My priority date is May 10, 2010.
