To share,
According to my lawyer, I cannot PP a Eb3 because it requires an original
Labor Certification to PP.
Currently Eb2 PD 12/2012, the orginal LC was filed with a eb2 140, so now no
original LC to file with a eb3 140. Hope this information help for anyone
is looking to file a eb3 with a pending eb2 now.

So he said the timeframe is 4 months to a year to file a eb3 140. I wont
file a eb3 140 now since Eb3 might retrogress in few months. So my case, too
late to file eb3 140 now.
eb2 485 pending over 180 days now, looking to find another job and wait for
rfe under eb2 sometimes next year with the new employer.
any thoughts? good luck to all of us waiting for a green card. such a long
wait.

律师说的不是圣旨 实践出真知
14年降级的情况是不要无perm原件直接pp 会被reject
可以在一个月左右之后尝试追加pp
去年的情况有变 不少人无perm直接pp也成功了
pp失败了钱会退无不良影响 只要律师或者公司hr同意签字完全应该试试

If i file eb3 140 now, PP next month and get approved in March, then move to
a new job in April, is it true that i cannot relink back to Eb2 at the new
job?
And i should not move to new job before eb3 140 get approved, right?
I know that Eb3 will be at least 6-12 months sooner than eb2 with my PD. It
is a bit hard to decide because i want a new job badly now. With a eb3, i
probably need to stay till the end of 2016 or at least later part of the
year at current job. Very tormenting. I am actually preparing myself for a
ref with a new employer that i am planning how to construct my new job evl
letter to domenstate the essential similarity or supplement j if needed.

it is great to know that i can relink back to eb2 at new job. I am going to
tell the lawyer about the PP. If PP is successful, i am looking at 2 weeks?
