我有前一家公司EB2 I-140 approved，PD是2012年7月31号. 新公司perm批下来一两个
月了，马上要file EB2140 and 同时recapture 之前PD date.
我的问题：是不是可以直接请公司file EB3（10月就 current了)，同时提交485，
recapture之前的PD. 这样做是不是可以操作办法，可以最快拿卡？有什么风险吗？比
如如果eb3突然倒退，我不能回到EB2……

EB3 140+485。
no brainer.
风险有那么一点点。但是你需要再回二类的可能性很小，肯定在三类早绿了。
好奇你的律师难道不是这么建议的吗？

Thanks. lawyer can directly apply EB3 with 485.

For my case,if i directly apply EB3, how to understand "风险有那么一点点"?
For example, EB3 back to 史前 in Nov, or DEC, what will happen to me. what
is my backup plan?

it is extremely unlikely for eb3 to retrogress in nov or dec. less likely
than you being hit by a bus tomorrow.

Thank you.
Last question, for my case , if I submit the 485 on Oct, what is next
significant step. In another word, during 485 till to get green card, what
is significant time point I can sure I am safe. For example, if EB3 back at
some time at next year, but at that time I don't get card yet. is that
affect my 485 process?
Is that rule still available, after submit I485 180 days, I can get EAD card
and free. Thank you very much.

can I get I-140 approved with express way to recapture my old PD by 15 days?

I ask these question, because that I heard that EB3 upgrade to EB2 is really
difficult. I don;t what that happen to me. :)

就你这PD再需要回二类的可能性几乎为零。
你的情况该如何做选择太显而易见了。
