求问现在H1 extension多久能批

求问现在H1 extension多久能批# EB23 - 劳工卡

昨天刚收到485 receipt，RD是11月初。里面还有个8月初的priority date，难道EB1也
有priority date？那个priority date怎么算的呢？
还有看版面上信息，大家都是RD后一个月就拿到combo了。老板正push我12月中旬出差
呢，这个时间估计AP能在走之前拿到（当然如果没拿到是不会走的）。到时候回美国的
时候有valid H1B，有AP，当然不会去申请VISA。请问这样回来有没有什么风险之类的
？总觉得还没拿到绿卡没有VISA拿着个AP晃晃悠悠进来心里会很忐忑。。。

紧急求助，在版上查了半天有的人说1个月就批了，有的人说得7－8个月，好焦心。
因为ld的H4 EAD申请也因此pending，他正在跳槽中，新雇主说他H4 EAD快过期了要他
给新的EAD，不知道多久能下来。。。
还有就是pp今年10月能重新开放吗？

Priority date is the first day that USCIS receive your immigration petition.
Using AP would change your status to AOS, although there is subtle
difference with using EAD.
No worry for using AP.

那进入AOS的话H1B还是valid的吧，万一485出现问题还是可以用H1B status 吗？没有
换工作打算。

unfortunately if you are under AOS and got 485 denied, you lose your status.
To avoid this you should consider entering the US with h1b visa.
however 485 denial is a rare case.

Just to confirm, even if this happens (under AOS with 485 denied), the
status to stay in US is lost including both H1B and AOS status. But H1B
approval is still valid, and one still can go back to a US consulate in
China to get an H1B VISA and reenter US with an H1B VISA, right?

This is right.
In fact your h1b is already lost when you enter with AP and become AOS (
again, there are subtle complications but you should forget about it)
You can re-enter with h1b visa, if you can obtain one.
