奇葩问题: 之前H1b extension被REF后未处理，现在还能新申请么# EB23 - 劳工卡

先把奇葩情况说一下吧
h1b第一个3年的到期时间应该是 2017.9月
2017.3月的时候律师开始帮pp申extension；而在申extension期间，我跑回国内出差（
并不知道原来这期间不能回国）
鬼扯的是2017.4.29的时候告诉我被ref了，因为申extension的时候我人在美国国外。
当时的原话是：
Thank you for your message. Please note that the initiation email that
Lawyer C sent you on March 14 stated that you must be inside the U.S. when
the extension is filed with USCIS. In this case, I will request that USCIS
issue your H-1B approval notice as a Consular Processed petition. This means
that in order for you to activate that petition, you will have to travel
abroad (if you are already in the U.S.) and then return to the U.S. after
the validity date of that approval notice. If you return with your current
approval notice, you will only be allowed to remain in the US until 9/8/2017
. After that you will need to travel abroad, most likely obtain a new visa
stamp, and activate your next H-1B (which would start on 9/9/2017).
Can you please clarify whether you have already submitted your visa stamping
documents to the U.S. consulate?
I should be submitting the RFE response sometime this week or at the latest
early next week.
之后在2017.5月的时候，用旧的h1b申了个签证（也就是2017.9过期的797，并没有去走
Consular Process之类，就普通申了个h1b签证），回到美国辞职，当时也并不知道h1b
extension下来了没有，律师一直没有回话
那么问题来了
1）现在这个情况，我想回去美国工作的话，还能重新申请一个H1b extension吗？之前
h1b extension ref的问题会影响新的h1b extension吗？
2）如果问到律师之前的h1b extension通过了，那么现在（2019.2月）还能用新的h1b
去工作吗？（问律师很困难，因为都已经不是我的律师了，而且那个特定的律师还换了
律所）
3）如果1和2都走不通，那我还有什么option吗？有没有可能必须要重新抽签？
