I know, my concern is that from my understanding, H1B starts to take effect from Oct. 1st, so between July 14(the last day of my OPT) and Oct. 1(which is usually called the gap), I am not elligible to work, correct? what can I do? since the school starts from August. I don't know what to do in this case.
If your lawyer can appeal to USCIS and argue that your teaching position is related to a university research program, or any higher education activities , then your H1-B won't be subjected to quota, and you might get it before 10 /1. If that does not work out, you can ask to observe in class until you are allowed to work. The school will find a sub for your position.
