现在纽约地区审查官(或者 DMV 官员)没有起诉肇事者,其实不是他(她)的错,而是
因为纽约州市刑事案件的标准问题。不同于其它州,纽约的有关汽车杀人的法律比较特
殊:如果司机驾车杀人,只对酗酒或吸毒的司机起诉其“驾车杀人”罪或“凶杀”罪。
如果想起诉“过失杀人”罪,必须证明司机在肇事的时候是“罔顾后果”地在开车(
reckless driving);这是一个比较难达到的标准;而在其它州“过失杀人”罪只需证
明肇事者和其他普通司机相比,开车时没有“合理谨慎”地开(fail to exercise
reasonable care),这是一个较低的标准。因此,地区审查官(或者 DMV 官员)在这个
案子上也是照章办事,无能为力。
那现在去 change.org 签名有可能让地区审查官改变不起诉的决定吗?答案是:几乎不
可能。美国三权分立。地区审查官属于行政权,法官(司法权)无法改变地区审查官或
者 DMV 官员(行政权)正当行事其权利的决定。这在美国联邦法院有判决书做依托:
Inmates of Attica Correctional Facility v. Rockefeller。在这个案子里,监狱罪
犯因不堪虐待而起义,劫持人质;警察和政府军镇压,肆意杀人(包括无辜的人质),
死了三十几个人。结果地方检察官拒绝起诉开枪杀人的警察。对此,法院无能为力。
哪什么方法能避免此类事件的再次发生呢?利用政治途径(political process)。其
一是换检察官(一般是当地政府任命的);其二是让立法机构更改不合理的法律。这些
都是有效果方案;虽然和中华文化没什么关系。美国是个(至少自我标榜的)法制国
家。
个人认为,华裔不缺乏看见一个旗帜或口号合意,便揭竿而起的人;但缺乏能够提出在
美国环境内(法制下)“合情合理”的旗帜或口号的人。
当然,如果我上面的分析尤其是结论根本就是错的话,我会很高兴。该案的重点是民事
诉讼,这个才能要到赔偿。请个好律师吧。证据对死者一方有利。陪审团也应该是公正
的。

Manhattan District Attorney Cy Vance dropped assault charges against a hit-
and-run driver accused of intentionally ramming a cyclist with an SUV,
allowing the defendant to plead guilty to leaving the scene and pay a small
fine, according to court documents and the victim’s attorney, Steve
Vaccaro
.
The cyclist, who sustained lacerations to his face and needed some 40
stitches, reached a civil settlement for financial compensation, but
Vaccaro
is troubled about the message the DA is sending to wantonly reckless
drivers.

Hsi-Pei Liao always thought that bustling city streets and erratic traffic
were just part of living in New York City – until his 4-year old-daughter
was killed by a car.
Liao’s daughter, Allison, and 71-year-old mother were crossing the street
in Flushing, Queens, on October 6,when a driver came barreling through the
crosswalk, running over the child and and injuring her grandmother.
“As much as I want to kill him, I don’t want to say ‘Blame the driver,’
because he is a human too,” Liao said.
The driver, Ahmad Abu-Zayedeha, had alcohol in his system but it was under
the legal limit. In New York State, drivers can only typically be charged
with vehicular homicide or manslaughter if they’re under the influence of
drugs or alcohol at the time of the accident.
Abu-Zayedeha received two summonses, one for failing to exercise due care,
and one for failing to yield to a pedestrian.
Since the tragedy Liao has become an active member of Families For Safe
Streets, a pedestrian safety activist organization lobbying for a local
speed limit of 20 miles per hour and harsher penalties on drivers involved
