I am at my fifth close to sixth year H1B. My initial H1B starts on October
2006 and my six year will end October 2012.
I changed one employer during my past few years. My current employer
started my Green card processes, and I got my I-140 approval around April
2009, more than one year ago. My current employer filed an H1B extention
for me on January 2010 till January 2013, because of my I-140 approval.
My current company is thinking of terminating my employment in this October.
They will most likely withdraw my H1B and I-140.
Question 1. Does that mean my H1B will end in October 2012, or January 2013
because of I-140 approval, after their withdrawal? How does the six year
rule work?
Question 2. Once they withdraw my I-140, does that mean I will no longer get
3-year extension for my H1B from a new employer that I find later after
termination? Then I will only have less than one year as an H1B to work for
them?
Question 3. Does my current company have to withdraw my I-140 by law? Or
they may choose to maintain my I-140?
