正准备找faculty的工作。好巧不巧post－doc老板实在是没钱了，实验室的哥们都作鸟
兽散了。也正在找新的postdoc位置。但是万一不顺利，歇业在家的话，对找faculty工
作是不是会有影响？请各位大牛指点。多谢！

小李在一家外贸公司是跑市场，虽然年龄不大，是一个95后，但是相关的工作经验已经
有了几年的时间了。这不最近清明节小长假到了，但是正好公司最近有一些单子需要有
人跟进，而且加班的人，公司不但会给3倍的工资，而且额外还有奖金。
小李知道这个事情之后，心里想反正自己放假也是一个人，还不如在公司加班，这样还
可以多赚一点，于是小李就找到了老板主动要求加班。但是老板看了小李一眼说：“这
个单子比较复杂，感谢你的主动担当，但是我觉得还是让老徐去弄吧，下次有机会我会
让你去的。”老板说完之后，就把老徐叫到了办公室说明了一下情况，老徐知道后说：
“还是让年轻人出去锻炼锻炼吧，反正我年纪大了，还有家庭，正好放假回去看看家人
。”
小李没想到的是自己满腔热血的想要工作，主动要求工作，但是结果被老板泼了一脸的
冷水。小李继续说道：“老板可以放心，这种业务我也比较熟悉，难道是老板嫌我的能
力不行吗？”说完之后小李就走出了办公室，小李回去之后越想越生气，心里想跟着这
样的老板也不会有什么前途，都不给自己机会展示，于是就去人事部提交了离职报告，
当天就离职了。
第二天早上小李正在睡觉接到了老板的电话，老板让小李去公司一趟，小李到了公司之
后，老板对他说：“你的离职报告我没有批准，已经被我撕了，我知道你现在很生气，
因为昨天的事情。昨天老徐在场我不好说，老徐家人生病了需要钱，但是老徐又非常的
要面子，所以我让他去加班，就是想让他多那点钱去看病。不是你的业务能力不行，明
白了吗？你明天继续来上班吧。”

Question 11. When is an I-140 no longer valid for porting purposes?
Answer: An I-140 is no longer valid for porting purposes when:
A. an I-140 is withdrawn before the aliens I-485 has been pending 180 days,
or
B. an I-140 is denied or revoked at any time except when it is revoked based
on a withdrawal
that was submitted after an I-485 has been pending for 180 days.
意思是180天内withdrawn 或 revoke就不能port 其他情况应该都可以port 140
Question 10. Should service centers or district offices deny portability
cases on the sole
basis that the alien has left his or her employment with the I-140
petitioner prior to the
I-485 application pending for 180 days?
Answer: No. The basis for adjustment is not actual (current) employment
but prospective
employment. Since there is no requirement that the alien have ever been
employed by the petitioner
while the I-140 and/or I-485 was pending, the fact that an alien left the I-
140 petitioner before the I-
485 has been pending 180 days will not necessarily render the alien
ineligible to port. However, in all
cases an offer of employment must have been bona fide. This means that, as
of the time the I-140
was filed and at the time of filing the I-485 if not filed concurrently, the
I-140 petitioner must have
had the intent to employ the beneficiary, and the alien must have intended
to undertake the
employment, upon adjustment. Adjudicators should not presume absence of such
intent and may
take the I-140 and supporting documents themselves as prima facie evidence
of such intent, but in
appropriate cases additional evidence or investigation may be appropriate.

刚才才搞清楚file485的几个术语
MD - Mailed Date ( This is the date when your attorney mail your application
to Lock box)
RD - Received Date ( This is the date when your application is received)
ND - Notice Date ( This is the date where they will send you the copies of
receipts)
