Dear All,
Right now I am working in a consulting company. In April, my company filed
the H1B application for me ( approved, OPT expired on Aug, 2007). My son has
always been my dependent ( so his F2 should expire on Aug. 2007 also).
So when I applied the H1B, I told my company I would like to apply H4 for my
son at the same time and gave all the documents needed for my son. Since
our company keeps the I-797 notice of action. So I did not care whether I
received the I-797 for my son.

your son may have trouble in applying for H4. Those time will be illegal
stay for your son. The question is whether your attorney can explain to
USCIS that this is an accident and out of your control. I am assuming your
son's F2 expired on 08/01. So his out of status is about 5 month. Maybe
there is some chance that USCIS allows your son to change status without
having him leave US.
