2006年7月6日拿到绿卡,一直住在美国,最早什么时候可以申请入籍?
这5年是calender year吗?

in fact, it should be 5 years - 90 days. I have heard cases that USCIS does
care about the a few days.
from N-400 instruction:

If you are applying based on five years as a LawfulPermanent Resident or
based on three years as aLawful Permanent Resident married to a U.S. citizen
,you may apply for naturalization up to 90 days beforeyou meet the ''
continuous residence'' requirement. Youmust meet all other requirements at
the time that youfile your application with us.

我只知道你是这个班上的老大,不过,我从instruction上抄下来的说明你都要反驳?
我之所以要强调5年-90天,不是4年9个月,是因为USCIS有追究这几天差别的先例。就像B2签证入境是180天,不是6个月一样。
另外,5年-90天的时候就可以申请。申请之前,要在当前的jurisdiction连续居住3个月以上,那是另外的要求,与这个没有直接关系。

我反驳自然有原因的。
Application Procedure
1. Applicant required to submit a naturalization application(N-400), a photo
copy of his/her resident card, two color photos and any other supporting
documents prior to examination.
2. Applications can be filed up to 3 months before someone meets the
continuous residence requirement. INA §334(a), 8 U.S.C. §1145(a).
Applicant filed after June 29, 1999, are screened to determine whether they
filed prematurely because they were filed

还有一个问题:
这其中每年最少在美国居住一半以上的时间,
是指连续居住6个月以上,还是加起来够6个月就行。

最好是连续六个月住在美国。一旦你没这么做,移民局就可能怀疑你想放弃绿卡。读一下这个帖子。

I do not care Kurzban's Immigration Law Sourcebook, I only care about official USCIS instruction. There are too many stup*d lawyers and too many wrong books.

but how long will take from application to approval?
will it be over 3 months?

it is about 4~5 months now. unofficial opinion indicates that CIS will not
schedule oath before the 5-year anniversary, if that was your question.

I did not. However the mod of this board should not give technically
incorrect info, as it might have unintended consequences. As I pointed out earlier, I did see on one immigration forum that an N-400 application was rejected based on this sole ground of a few days too early. I am also surprised that a law student would cite a secondary reference (some lawyer's book) over a primary reference (either gov/executive, in this case CIS, or legislative, such as federal code).
