我们家是9月初交的485，本月初收到Receipt。LD是H1，主申请人。
我目前也是H1.在实验室工作，很辛苦而且没有credit，实在受不了，想辞职。每天回
家脖子都是僵
硬的，几个小时显微镜下工作以后都感觉恶心，想呕吐。
如果我想现在辞职，必须转成H4维持身份吗？ 还是可以用pending的485就可以了？
真的感觉是绝望无路了，ld不愿意给我转成H4，说最快等绿卡批了才能辞职，但是我实
在坚持不了
了。
请教大家，谢谢了

485 pending就是AOS身份，不用转H4也是合法的。当然，万一485被拒的话就立刻黑了

我这周就这个问题专门去问了我的移民课老师，她也是移民律师。她认为实际上485
pending 就算是有效身份了。
你的情况是配偶，可能就更无所谓了。可以辞职。不过先请个长假，比较划算。我们单
位以前可以leave of absence，leave without pay一年。这个一年其实算你的H1还是
有效。这应该是最佳方式。

I have the same situation. Eb1a 140 was approved. Now 485 and 765 is pending
. New company is willing to sponsor me H1b. Can I accept the offer and work
for the new company?
