EB2 PD是07年12月，485没有办法交上去。LD的h1b马上就6年了，LD的公司没有给办140
,这种情况
下，是不是LD只能转成H4了？还是她也能延H1b,因为我在file我的140的时候，她的名
字也在上面
（140批件上只有我的名字）。

If she has got her PERM approved or her PERM has been pending for more than
a year, then she can use PERM to renew her H1B.
She may not be able to renew her H1B using your 140. Several years ago, a
friend of mine successfully renewed his H1B by using his wife's 140. But my wife did not have that luck, since her H1B renewal (using my 140) got rejected. It's a grey area.

If your wife has her own PERM or EB2-140 approval, she will have no problem
renewing her H1b status, but if she does not have that, that might be a
problem. Why do not you ask your wife to consult the lawyer of her place?
