我现在H1B, 想申请NIW. 但是没搞清labor certificate waiver 的意义. labor
certificate是什么? 是不是就跟H1B 类似的. 因为搞不清, 所以不知怎么petition.
可以petition 因为labor certificate 申请时间漫长, 所以无法跟H1B sponsor之外
的公司合作, 推广我具有national interest 意义research & project?

1. 对国家有好处(经济，环境，就业等等)。
2. 影响是全国性的。
3. 如果要labor certificate的话，国家利益受损。
第一条很容易证明，不管你是做什么的都可以或多或少扯上关系。第二条也比较简单
，就是狂吹自己的贡献很广泛。前两条都不用浪费笔墨，除非你的工作和国家利益的关
系比较牵强要费点口水联系在一起。
关键是第三条的论证。第三条的话，见到过几种版本。但大家都有一个原则，就是从多
个角度论证要labor certificate的话，国家利益会受损。那几个角度呢？经常提到的
有1. 过去的成就会证明将来有更大的贡献(你以前的研究证明了你的能力，也证明了你
能在现在做得更好)。2.你本人很牛B。3.你的贡献远超others with minimum
qualification。 4.要labor certificate的话，国家利益受损。而你的想法在我看来
可以用来证明第四条。

labor certificate(劳工卡)是基于雇佣的移民申请的二类或三类（EB2,EB3）的第一步
，其核心就是通过一定程序和步骤，在一定时间内，对于某职位找不到合适的美国公民
和永久居民，而必须聘用一名外籍员工，从而申请移民。这与H1B有些类似的地方，但
完全是两个概念，没有太直接关系。你可以读读如下文章

EB2-NIW（国家利益豁免）就是说基于国家利益考虑，豁免掉劳工卡申请而直接申请移
民。

两码事。labor cert定义如下。而h1b是petition for non-immigrant worker.
A permanent labor certification issued by the Department of Labor (DOL)
allows an employer to hire a foreign worker to work permanently in the
United States. 走公司的话，公司要先办perm，可以看作是可以帮你办绿卡的第一步
。目的就是证明给移民局看找不到符合条件的人，所以要雇用你这个老外。然后是140
，485.
自己办niw的话就省掉这第一步。这也是问什么你要费尽心思证明如果要办这个的话，
会损害国家利益。

Issue II The national interest would be adversely affected if I am required
to obtain labor certification
A My prior achievements have significantly impacted my field and are
further evidence of my ability to contribute more significantly to this
research than most other researchers and would justify the projected future
benefit of my work. I have produced several important contributions to
XXXXXXX. Professor XXXX comments in his evaluation, “XXXXX” (Exhibit 2).
XXXXXXXXX
I also made original and significant contributions on XXXXXXX.
As further evidence of the impact and significant of my work,XXXXXXX
states Dr.XXXX in his evaluation in Exhibit 4.
It is abundantly clear that I have produced original scientific
contributions of major significance to the field of XXXXX and have truly
established myself as an outstanding scientist in these fields. (Exhibition
1-21).
B. I possess unique and innovative skills that serve the national interest.
The provided evidence showed that I have unique and high valuable skills for
my research. Professor XXX states, “XXXXXX
As Dr.XXXXX comments in his independent evaluation, “His education and
past research in XXXXXX.” As a labor certification process can only take
into account basic skills and not high-level talent, my unique and high-
level skills are beyond the scope a labor certification process.
In addition to my technical abilities, I also exhibit XXXXX”(Exhibit 3)
C. The national interest would be adversely affected if a labor
certification were required. In this instance, I am not seeking a national
interest waiver as a result of a labor shortage, but rather to secure my
specific services as a result of my ability to contribute more significantly
to my research field than the vase majority of my peers and other more
experienced scientists. Because a labor certification process is a
standardized one that relates to minimum requirements of education and
experience, such a process will not take into account these crucial factors.
In other words, many of the essential qualities that I have, which are so
important to serving the national interest, will not be articulated in a
labor certification process. Moreover, failure to consider these factors
would result in a denial of a labor certification because of a U.S. worker
with only minimum qualification might be found. Since I will serve the
nation to a substantially greater degree than anyone with minimum
qualifications, my non-participation in my current work would deprive the
nation of my exceptional and crucial contribution to the national interest.
As a result, experts in my field all agree that the loss of my significant
contribution would be contrary to the interests of the United States, where
requiring a labor certification adversely affect the national interest.

certification were required.
