The petitioner provided a report based on her/his anatomic analysis carried
out by a US doctor certified on board indicates that she meets the criterion
of being a pure female. Even though further chromosome analysis revealed
she/he has a XXY kyrotype, we could not argue this criterion based on the
issue that is not well resolved by experts themselves according to US
immigration act regarding the undefined condition pertain to the immigration
pursuant.
The petitioner claimed herself as being ugly, while most Chinese
regard her looking as repulsive, the opinion itself could not establish that
the petitioner is an international recognized ugly woman. For example, most
American people love this Asian looking and deem this looking as beautiful
if not gorgeous. Please provide further evidence for being regarded as ugly
woman, for example, the opinion from those people are not from US or China
and not Caucasian or Asian ethnic groups.
The petitioner claimed the fact that she is an internet celebrity and was
reported by many media including Chinese TV show, magazines and even
Wikipedia. The Wikipedia, the largest and most popular general reference
work on the internet has an estimated 365 million readers worldwide. However
, according to Wikipedia self explain:"Its 20 million articles (over 3.78
million in English) have been written collaboratively by volunteers around
the world. Almost all of its articles can be edited by anyone with access to
the site", given the open-access nature of Wikipedia, the petitioner has to
provide further evidence to demonstrate that the article about the
petitioner is not self-purported or edited by someone with conflict of
interest. The evidence in Chinese TV show and magazines appeared to be solid
albeit they are all regional media. The notarized translation of the
magazine and subtitle of the TV show was not provided by the petitioner in
the first submission.
One of the evidence the petitioner presented as being outstanding and
international recognized was the fact that she works for Carrefour in
Shanghai. Carrefour is one of the largest hypermarket chains in the world
headquartered in France. It has many retail departments around the world.
Shanghai Carrefour is one of them. Being an employee of Carrefour could not
separate the petitioner from other employee. Please provide further evidence
to show the petitioner is on the top 5% percentile compared to other
employee having the same ugly face.
The petitioner further claim that current immigration request is based on
her extraordinary ability rather than a marriage-based green card pursuant.
Increasing number of fraudulent marriage was observed recent year and large
proportion of Chinese women could not prove a bona fide marriage during the
fraud interview in USCIS.
In November 2009, the petitioner passed out flyers in Shanghai seeking a
marriageable boyfriend, who as said in her flyer "must be an elite with a
degree in economics or similar from Peking University or Tsinghua University
" and "must also be 176 to 183 centimeters tall and good looking." The fact
that a lot of WSN graduated from above mentioned universities with good
looking and a degree with economics work for Wall Street increases the
possibility that the petitioner is a pursuant of marriage-bond green card.
The petitioner’s current address listed in her I-140 form indicates that
she is currently a resident in New York City. This increases the probability
of her initial intention of pursing an I-485 WSN who works for Wall Street
with a good looking and graduated from above mentioned universities.
The petitioner claimed that she is “the brightest human being in the past
three centuries, and added that she would remain “the smartest person for
the next 300 years.” It is apparently a false comment based on the fact
that no one can live up to 150 years except a tortoise. The immigration
category the petitioner claimed does NOT accept things that would possibly
happen in the future. All the evidence made after the first submission date
are not acceptable. Therefore, the claim “the smartest person for the next
300 years” is annulled.
