fresh在校学生即将毕业，请问on campus面试和走正常路线有什么不同吗？？我只对算
法数据结构相对较熟悉，还有一些乱七八糟的题目都不是很熟。。比如正则表达式之类
的。所以想问一下对于fresh初级SDE的面试着重点是不是就是在算法和数据结构方面，
其他哪些地方还需要cover到？

I googled more to know that "EB1 can be applied while you are outside USA. A
new employer can sponsor only after you have worked for them for one year
outside USA." Is it so?

When outside of US, one year employment is needed before application. How
about the case when the applicant is in US then?
I know that somebody get EB1A approved with just a job offer without working
during application time, but I am not sure about EB1B, which supposedly
requires sponsorship.

O1 批了可以工作。申请EB1B，绿卡下来前可以先用EAD工作，如果 EAD 先批的话（H1
已经用完了，不然H1容易），EAD 申请不能PP。可能时间比O1 长。
PP是说140的。

I see. That's what we are trying to figure out here. I know an ID who got
EB1A approved without working then, but he had a job offer.
But for EB1B, can it be applied before working for the company? It still
sounds a bit unreasonable.

I think without a job offer, Eb1a-140 should be fine. Although if there is
one, that will be better.
However, for 485, USCIS might want to see a real job. Since EB1a is still
employment based. As written in the 485 instruction, EVL is a must for all
EB I-485.

I did not find official website, however, this one said something similar to what I have seen before:
"The EB1B petition is for future employment, so you only need to have the
intention of taking up the job with the sponsoring Employer when the I-485
is approved.
It doesn't matter whether you join from your current employment or another
one you have taken whilst the case is pending.
What you can't do is refuse to join the sponsoring employer when the I-485
is approved because you have found a better job."

This is consistent with some other discussions that I have seen before.

EVL can be for future job as well.
Offer letter is addressed to the person who is apply for GC.
EVL is addressed to USCIS.

这是讨论申请人算不算三个研究人员之一时候提到的一段，从AAO的administrative
decision里面抄下来的。头几句似乎暗示有一种可能雇员还没开始工作，但已有了
offer。
If an alien researcher is currently outside the United States, and intends
to enter the United States with an immigrant visa, then the prospective
employer must already employ at least three full-time researchers in the
relevant department, division, or institute. In such a case, the three
researchers obviously do not include the alien. Thus, the statutory
construction demonstrates that the alien must seek to become the fourth
researcher in a company that already employs three other researchers. In
instances where the alien is already in the United States as a nonimmigrant,
and the alien has joined two other researchers to become the third
researcher, then the employer does not satisfy the statutory construction.
There is no regulatory or statutory justification for the arbitrary
assumption that a company too small to petition for a worker who is still
overseas can, nevertheless, petition for that same worker if the worker is
already in the United States as a nonimmigrant. Therefore, we find that the
position held by the alien beneficiary shall not be counted as one of the
three persons involved full-time in research activities.

O1 批了可以工作。申请EB1B，绿卡下来前可以先用EAD工作，如果 EAD 先批的话（H1
已经用完了，不然H1容易），EAD 申请不能PP。可能时间比O1 长。
PP是说140的。

I see. That's what we are trying to figure out here. I know an ID who got
EB1A approved without working then, but he had a job offer.
But for EB1B, can it be applied before working for the company? It still
sounds a bit unreasonable.

I think without a job offer, Eb1a-140 should be fine. Although if there is
one, that will be better.
However, for 485, USCIS might want to see a real job. Since EB1a is still
employment based. As written in the 485 instruction, EVL is a must for all
EB I-485.

I did not find official website, however, this one said something similar to what I have seen before:
"The EB1B petition is for future employment, so you only need to have the
intention of taking up the job with the sponsoring Employer when the I-485
is approved.
It doesn't matter whether you join from your current employment or another
one you have taken whilst the case is pending.
What you can't do is refuse to join the sponsoring employer when the I-485
is approved because you have found a better job."

EVL can be for future job as well.
Offer letter is addressed to the person who is apply for GC.
EVL is addressed to USCIS.

decision里面抄下来的。头几句似乎暗示有一种可能雇员还没开始工作，但已有了
offer。
If an alien researcher is currently outside the United States, and intends
to enter the United States with an immigrant visa, then the prospective
employer must already employ at least three full-time researchers in the
relevant department, division, or institute. In such a case, the three
researchers obviously do not include the alien. Thus, the statutory
construction demonstrates that the alien must seek to become the fourth
researcher in a company that already employs three other researchers. In
instances where the alien is already in the United States as a nonimmigrant,
and the alien has joined two other researchers to become the third
researcher, then the employer does not satisfy the statutory construction.
There is no regulatory or statutory justification for the arbitrary
assumption that a company too small to petition for a worker who is still
overseas can, nevertheless, petition for that same worker if the worker is
already in the United States as a nonimmigrant. Therefore, we find that the
position held by the alien beneficiary shall not be counted as one of the
three persons involved full-time in research activities.
