My EB1B application was denied. Could anyone tell me whether I must file an
appeal within 30 days or I can just file another petition anytime later?
EE, PhD

这样的case一般顶多是RFE的，怎么直接被据了呢？什么理由？

这新年上班第一天怎么都是不好的消息。据说appeal费时又费钱，而且还很难推翻原判
决（版上说的）。
BTW,你这case对1B来说应该是挺强的，还悲剧，吓死偶也。能给些更详细的信息吗？
你的case和Danceforlife的很相似，相似的背景，悲剧于同一个IO.

0002 著名的NSC ，前两天我们才讨论过。他习惯在据人之前先发RFE,然后再据。所以
上次我说他可能是个比较senior的人，才会搞到比较多的case.
你的case 在EE里面属于还是可以的，材料可能没组织好。单从你提供的材料看，
international recg as outstanding尚无法证明， 2 patent可以论证original
contribution,但是尚不能论证significant contribution. 建议重新组织一次材料，
在重新file.
appeal 从前不久一个哥们的奋斗史来看，耗时6个月之后仍然据掉，这样太不合算。
当然我也没有看到别的appeal以后很快成功的案例，仅供参考。

I got denied by the same guy. Based on the letter, I suspected that he didn'
t even look at the new evidence I submitted. But he gave me a long letter (
seems like he reviewed all evidence carefully), saying that international
recognition is not met.One of the reasons he gave is publishing and
reviewing papers are the routine job of a researchers, so they are just your
original research/presentation, not original contribution.
I asked many lawyers afterward, no body suggested appealing.I will refile my
case in a few months.

I got a very similar letter like yours. The RFE letter is identical to the
denial letter. This guy has a title of "acting director".

I have another two letters from my managers, one is about my job performance
, the other is about a patent to be commercialized.
My lawyer said there is no need to add more similar letters. It seems that
his strategy doesn't fit with 0002

单独file 140，还是140+485?
我当时pp了，也落到了这个人手里，RFE补交了各国8封推荐信都没过。。。
有时候运气真的很重要。。。。。bless我们俩下次能过。。。。

这个其实也是我最想说的，千万不要只有plain text，
一定要有详尽的描述，摆事实，讲道理，列数字，列对比。如果都是plain txt,
8篇推荐信很容易被解释成为，推荐人都是
either working close to you or former collegues ...
就算你不是，他们也不给你机会解释。

claims of the ten, but was denied for the Final Merits Determination
because of limited citation numbers (n = 120)

I think NE 0002 is a tough officer. My background is
Environment Science, Ph.D
Till to the RFE letter submission, I have 17 English journals, 4 Chinese
journals. Of which, 13 English journals where I'm the first authors,
including one published in Nature-sister journal. I reviewed about 30 times
for the good journals in my field, and played as editor board member for 3
journals.
I have consulted with two lawyers this time, and was recommended for re-
filing the case. It seems appealing or motion to re-consideration are both
not advised.
"My EB1A got denied by the same officier in NE. My case has been passed
three claims of the ten, but was denied for the Final Merits Determination
because of limited citation numbers (n = 120)". I agree the citation numbers
are not good enough as the research that I have been focusing is a narrow
area in the field.

appeal if AOS/EAD is the only legal way you (or your derivatives)can stay in
USA legally.
file a new one if you (and your derivatives) have a status or can regain one
easily.
