EB1A 1月份approved after RFE。为了回报本版同胞,在这里把自己的思路,分析及应 付RFE的经历写出来,希望能对大家有所帮助。RFE letter和律师有协议不能分享。请 见谅! I-485递上去2个多礼拜了,希望早点收到FP notice和EAD, PA approvals。请大家 Bless我啊。~~~~~~ 本人TSC, case较弱:time line和background 见http://www.mitbbs.com/article_t0/Immigration/32203415.html 2011年10月时被堪称杀手的XM100号RFE了。查阅版上历史,既有disaimisong和 chestnut RFE对决#100失败的例子,也有faithlove的成功例子,但是置顶IO名单里100 号好像还是据的case多,批的少。0100: RFE (10), Denial (7+1*), Approval (5), 经验1 最重要的是要仔细阅读RFE letter,不管它是不是模板,一定要仔细读,然后有针对 性地应付。 经验2: 无数前辈指出过,自己的东西要自己上心啊! 即使你有律师,也一定要下足功 夫。我主要参考了analogs的 RFE葵花宝典, joymama的奇异恩典绿卡路和,和 laoda555的 如何写 EB1 RFE letter。把能挖掘的evidence都用上了。 claim了authorship,contribution,review;其中authorship和review两条过了; contribution没过。在original petition里,由于我和律师的疏漏,推荐信和PL里有 些许“which suggests”, “potential”, and “promising treatment”, “may provide”, and “it is possible”之类的词,和较空洞的“very significant”, “groundbreaking”, “novel discovery”,也被挑了出来。 给我的RFE信里核心部分是这样的。 Evidence of the beneficiary's original scientific, scholarly, artistic, athletic or business-related contributions of major significance in you field. The petitioner has provided the following: ------ Your work has been cited XX times ------ You have submitted 6 letters of support ------ You were the first to demonstrate that XXXXXXX ------ You suggested for the first time that YYYYYY in this pathway ------ You were the first to show that ZZZZZZZ This criterion has NOT been met because the evidence submitted does not show that the beneficiary's contributions are considered to be of major significance in the field of endeavor. Many of the letters were from individuals who already knew you, and the letters were general in nature, and did not establish your accomplishments are any greater that your peers. In some of your letters of supports the words “very significant”, “ groundbreaking”, “novel discovery” were used: however these words alone do not establish that your research is considered a major significance within your field. Upon closer examination of your research it has been categorized as “which suggests”, “potential”, and “promising treatment ”, “may provide”, and “it is possible”. While your research is helpful and has helped further additional research, but the record does not establish your research has made a major significance within your field. It must be noted it is not enough to have made a first discovery, but it must also be established these discoveries have made a major significance within your field. To assist in determining whether his contributions are original and OF MAJOR significance in the field, the petitioner may submit: (1) Objective documentary evidence of the significance of his contribution to the field; (2) Evidence of your work being implemented by others. Possible evidence may include but is not limited to (2-1) Contracts with companies using the beneficiary’s products; (2-2) Licensed technology being used by others; (2-3) Patents currently being utilized an shown to be significant to the field. (3) Any other relevant evidence Note: letters and testimonies, if submitted, must provide as much detail as possible about your contribution and must explain, in details, how the contribution was original (not merely replicating the work of others) and how the contributions were of "major" significance. General statements regarding the importance of the endeavors are insufficient. 大家可以看出,IO这次要的是真材实料,如果我回复RFE时候再是泛泛而谈,过的可能 不太大。仔细读过信后,再仔细品味analogs 提到过contribution是吹出来的,是软条 件。contribution一定去找找一下方面: (1)别人是否大段引用你的文章? (2)别人review你发表文章时候,时候给了大段的positive评论? (3)你的工作如何影响了后人?后人如何在你基础上做出了有影响力的工作? (4)你做的东西是否工业化? (5)你的文章被多少国家作者引用? (6)你的文章是否被牛人引用过? 我是这样应对的 (1) Objective documentary从original petition之后找到的4个网站(比如Newsrx, MDLink, Highbeam等)的media report入手,来支持contribution。其实这些reports 几年前早就有,只是original petition当时自己没有花那么大力气去挖掘出来。另外 就是找了4个大段引用自己文章的人写推荐信(RFE后厚着脸皮写信索要新推荐信,4个 人全部回信说可以),宣传自己工作的significance。 (2) Evidence of your work being implemented by others。应对RFE过程中,挖掘出 自己的2篇文章的结果,正被2个不同的公司拿来研发新药(很初始的阶段),这个被用 来大力的润色拔高。要提一句,我的成功和与当年PhD导师的良好关系绝对分不开! original petition他找来3封推荐信,他自己写了一封。这次RFE,药物公司拒绝出具 证明,他老又加了一封推荐/证明信,证明我的成果被业界应用,并附上了他和公司来 往的一些电邮。还有就是借4个independent recommenders之口,大力宣传我的成果重 要性,以及如何的深刻影响了他们的工作,其他科学家工作,导致了何等的科学进步云 云。 再有就是花大力气找citation,我把ISI, Google scholar, Scifinder,Scopus和CNKI 重新翻了个遍。又翻出来打个15个新的引用+以前没发现的旧的引用,然后又Google, Bing,Baidu自己的名字,关键词,文章名,杂志名等等,又搜出将近10篇(ISI, Google scholar, Scifinder,Scopus和CNKI没有的),这样加上原来的总它引就超过 了100。建议它引不多的朋友可以尝试一下。 能搜罗的,RFE都给搜罗进去了,幸运的是,RFE response4周后,I-140就approve拉。 现在USCIS实行两步法:1,10项符合至少3项;2, totality在top percentage。这个 totality的论证下次再写。 祝大家早绿!别忘了bless我哦。
首先教说话:No! Stop! This is not nice! Stop hitting me! 一定要教到娃吼出来,让旁边的人都震惊才算,蚊子叫不算。 然后就是教一些自卫的动作,比如拿东西,或者手肘迎接攻击,同时大声喊No! Stop! 一定要有气势!K阶段老师看得挺紧的,一定会注意到。 这么没有家教的小孩,以后就不要一起玩了,让娃发展其他的朋友,家长帮忙物色一下。
打得过就打回去,把对方打服了。次选就是打不过也拼命打,让对方就是赢了也要付出 沉痛代价。最差的是打不过,还手抗议但软弱无力,被欺负了还不吭声,这样是bully 最喜欢的。欺负着刺激还没后果,下次还找你。然后成了pattern就完了,别的孩子也 会加入进来。软柿子人都捏。 不想physical就大喊大叫。让所有人都盯着看。然后第一时间跑去告老师,要理直气壮 。He hit me!!!! He is mean to me!!!! 老师最烦搞事儿的刺儿头。来几回,就送那熊孩子去见校长了,就老实了。

Have the kids push the bully away,run to the teachers.(escape from danger) some kids, if you do not teach teach this point. they will accept the bully. 3. always maintain good relationship with teachers. after all, they are the only people at school watching kids, while you are not there.
