主要是上来给大家share一些常问的问题。
当时递交她作为副申请人的485的时候，填的Admission 是H1,因为当时她还有工作，递
交一个月后，失去工作。当时律师的建议是file一个H4准备着。这样如果绿卡申请失败
，起码她可以合法在美国继续住。当时有些担心这绿卡的case和这个I-539申请有没有
冲突。现在看来完全这是两个问题，并且在两个center互相不干扰，现在老婆已经拿到
基于485的EAD/AP.当时在填I-539的时候，A number就填的是移民局处理她485时候给的
A number, 填 Part 4 , C 的时候被问道是否file过485，填yes.
然后在cover letter里写明因为自己的老公申请绿卡，作为副申请人递交了485，所以
有A number, 并且 Part 4 c填 yes.
递交大概3个月20天，收到RFE.要求提供我的最近三个月的工资单证明我还在legal的H1
job. 递交的时候，递交了她的最后三次工资单。看来这个RFE是多半会发生的，因为
即便当时附加了我的工资单，还要被问到现在是否还有工资。

It's not uncommon for a H1 to F1/B2/F2/H4 COS to receive RFE for paystubs,
if you did not enclose them at the submission.
If your EB1-I-140 is already approved, there is really no need to spend the
$400 to do her COS. The risk of I-485 is low, and if denied, she can still
go to China for a vacation and return with H4 visa stamp.

Yes, I understand, but I already applied this case and paid the money.
It costs 290 USD. And my I-140 is still pending

这个的主要原因就是你已经file了485，所以现在dual status，移民局的人不好判断你
目前以何种状态存在于美国，呵呵。
