已经批准和pending的专利能claim为"PUBLICATION"吗？自己觉得可能不行，虽然这
些专利也有不少citations，可是不符合"authorship of scholarly books or
articles (in scholarly journals with international circulation) in the
academic field".还是想听听大家的意见和经验。
进了公司这几年, 公司说因为"trade secret"的原因，不允许发文章，只能发专利，
所以现在想申请EB1-B真是捉襟见肘啊。

我查了查，好像不能算啊，只能算contribution。而且
‘Patents or patent applications carry little weight unless they demonstrate
an international reputation in the field, and petitioner should document
the widespread use or application of the patent.’

但是，你可以找贵公司或者客户出证明信，证明应用很多
