老板突然通知到一月15号走人，找了半天只有同校的一个位置2月才能开始，中间的gap
会不会影响身份。
准备申请eb1a，材料都差不多了，准备12月提交，目前这种情况还能提交吗？

as long as USCIS receive your H1b transfer application BEFORE the day your
current h1b expires, you are OK.
You can submit I-140 at any time. However you must have a valid status or at
the very least a valid stay in the US to be eligible to file I-485.

current h1b expires, you are OK.

big bless! Is your current and next job both H1b? my understanding is that
it does not matter for H1b when to submit the eb1a. but for whether you can
still legally stay in the US for the gap, not so sure.

谢谢大家！两个工作都是h1b。就是同校内转到另一个系，不存在transfer h1b的问题
。但是就是中间有这么半个到一个月的gap。不知道会不会影响身份，如果递交了绿卡
申请，这个gap会不会有影响。

as long as you are still get paid as the LCA states, maintaining the same
title, it is fine.
However in case they would not pay you, you might consider use your annual
leave or so.
