My school attorney said my PHd years can't be counted as a full-time work
experience because I was on F-1! We do have the letter to prove my phD
research is outstanding, but he only counts my phd years as half time (about
1.5 yr) and asked me to get work certification from China to prove my
experience there.
I have never heard of that! Just don't know how to persuade him. Any
suggestion?

Along with my work experience in China, it is enough to meet 3-year
requirement. But I am not sure it is workable. My school attorney apparently
does not have much experience in EB1b.

的确有在claimed 领域要待满3年之说，这个经历国内国外都行。比如你有publication
，上过课，参加过学术会议什么的，只要能证明你持续的在同一个领域工作就可以了。
只是F1似乎不是tanure-track employee，所以不太满足EB1B的要求。
看能否试试1A。

你律师说的貌似没错，一般PhD期间都按一半时间计算，如果我没记错的话

Since you can work up to 20 hours per week as research assistant during your
Ph.D period, it is reasonable that it only count half time.
In order to prove your research experience in China, please check whether
you have some publications and patents. In addition, try to get a
recommendation letter to show you did outstanding work in China.

我以前和学校的律师讨论过这个问题
其实uscis的网站没有明确的说你要一个月工作多少个小时才算full time researcher
我律师当时还把uscis的网站里的条款找出来给我看的

我收到的RFE里，IO写的是，如果advanced degree得到了，并且在获取advanced
degree期间是outstanding的，就算。
