好在老公的地区不用排期。NIW我同时递交了140和485有2个月多了，但由于工作合同和
老板的原因不得不马上离开
美国回国去，应该回不来美国了。当时申请的时候就比较急，请大家指点我这种情况可
以在国内等吗？还有戏吗？是不是就回国就算放弃了？我记得有人说NIW可以在境外申
请的。我现在回去可能马上也找不到工作，现在觉得好迷茫。这是我以前的帖子。感谢
大家提供信息。

485pending可以合法留在美国,不需要马上离开美国回国去.在AP没有批之前离开等同放
弃485.
IO 审理140时如果发现你已经离开美国,也会产生不利影响.
请其他高手补充

NIW不是eb2吗，还没current，那递交485有啥用？
配偶是current的？

找稳胜律师事务所问问。两年前，在我来美15年时也走到了要离开美国的抉择时。稳胜
王律师帮我们想办法留在美国并在去年一月拿到绿卡。你可以去咨询一下。www.imlaw.

如果你夫妻俩都是中国大陆出生，那跟NIW一起提交的I485应该回被拒，因为排期还没
到

NIW你能cc,那说明你用的ROW,排期当前。如果你决定回国，那绿卡=nothing。如果你是
不得已暂时回国，将来还想返美，建议等拿到AP后再离境，因为AOS可以合法留。如
果不是必须离境的话，可以在美国等绿卡。拿卡后再从长计议。

由于工作合同和老板的原因不得不马上离开美国回国去
if your I-485 is pending (and your PD was indeed current when you submitted
I-485), "不得不马上离开美国 due to your status" is not applicable to you.
If you leave US before AP approval, and not coming back with H1 visa, your I
-485 is deemed abandoned.

我的理解是你是I-485 pending状态,现在是AOS身份,如果当前身份没了的话,不需要离
开美国的.你可以在美国等待485批准.
不放心的话找个靠谱的律师问问.

no need to leave US since you have a pending 485. You should get an EAD card
soon (if you filed i-765 when you filed concurrently) and with that, you
can work for others. Your background looks fine and your NIW should be
approved. After that, your 485 may also be approved without RFE. A worse
situation is that you get 485 RFE while you do not have a job at that time.
To be prepared for this, now try to find another position, and see if you
can transfer/extend your H1B upto the 6-year limit. By the end of the 6-year
period you should have your green card already or at least your 140
approved. If no chance to find a job that sponsors h1b, use your EAD card
to work after your current job ends. In the extreme situation where your 140
is denied and you get no job, you can leave US at that time, if that
happens unfortunately, you lose nothing extra, compared to the situation if
you choose to leave US at this time. Good luck.

我现在有个问题，NIW不是可以境外申请吗？那写申请人本身都不在美国的，也没有美
国的工作。怎么操作，想弄清这个万一用到。谢谢大家。

只要主申请人符合优先排期所需要的学经历要求，配偶是其他国家出生的，就可以用配
偶出生地国家的排期，至于配偶有没有工作，学经历如何都不是重点，重点是你们有真

看了你的背景应该可以试EB1A吧。485递了之后如果H1B失效也不用离开美国。

建议提交EB1A.PP+CC
推荐信着急写和修改的话，请律师帮忙。到7月份之前，还是来得及的。
看大家说的，有EAD就行。
再一个，你老公若有H1B/F1，你是否可以转成H4/F2 留下？如果真是别的办法都行不通
的话。
