老公申请EB-1， 他140今年三月份批准了，四月份我和我老公一起提交了485。5月初打
了指纹，到现在为止还没有收到EAD/AP.
现在我在用OPT, 七月初到期，今年H1b抽中了，但要10月份才生效。
请问大家7月到10月之间gap,能不能申请OPT extension? 或者有其它办法吗？

找学校弄个I-20把中间的GAP填了就行，，，不需要EXTENSION。。。。

别了吧，尼玛学校小蜜说我还是可以file OPT extension, 结果这765悲剧了

cap gap不是自动cover吗？

That means I can still work legally until Oct even though my current OPT EAD
expires? Thanks!

你那cap-gap是因为h1b approval来的
和你485没一分钱关系

OPT-H1B Gap和你的OPT EXTENSION是两码事。。。

楼上这么多同学说的是对的，OPT-H1B GAP自动，千万别extension。
每次看见这种贴，就很感慨本版，想想不在本班的同学，包括外国同学，特别我的一些
同事，完全没地方咨询(即使花钱找律师，现在各种不靠谱)

也可以读一下下面的link. 注意下面的"automatic"
"Once a timely filing requesting a change of status to H-1B on October 1 has
been made, the automatic Cap-Gap extension will begin and will continue
until the H-1B petition adjudication process has been completed. If the
student’s H-1B petition is selected and approved, the student’s extension
of status will continue through September 30. If the student’s H-1B
petition is denied, withdrawn, revoked, or is not selected, the student will
have the standard 60-day grace period from the date of the rejection notice
or their program end date, whichever is later, to prepare for and depart
the United States."

从规定上看确实是自动开始了~~不过我当时弄OPT的时候因为也存在OPT-GAP学校特别强
调让我到时候Update I-20到9月30号来填补CAP-GAP~~当时也咨询了我的移民律师她说
这个CAP-GAP的I-20和OPT Extension是两码事不会影响485的~~因为当时要RENEW驾照的
缘故所以就更新了I-20~~
