我现在是O-1,对于485pending的时候用AP出入镜有些疑问，担心O-1失效后万一485悲剧
，之后无法再申请O-1。今天得到律师助理关于我这个concern的回复如下：
I have confirmed with the attorney that as long as you have your AP/EAD card
, you can travel without risking abandonment of your pending AOS application
. In addition, as long as you travel with the AP/EAD card, your O-1 status
would not be in jeopardy and you would continue to remain in O-1 status
while the AOS is pending. If your I-485 is denied for some reason, you
would remain in O-1 status.
她的意思好像说O-1并不会失效。鉴于版上常出现的律师意见的乌龙，还请有比较清楚
的大神给看一下，律师这个说法是否可靠？

USCIC的Memo只提到可以回到H1，没说可以回到O1，所以回来后最好用EAD工作，或者重
新递交个I-485后备（$1070买个保险还是值了）。
不过被拒概率不高，到时再重新申请个O1也不是难事

expedited basis the regulatory change necessary to enable E and O visa
holders with I-485 applications pending to travel on their E or O visas
without abandoning their I-485 applications. Our proposal is outlined in

USCIS: appreciates the impact on the business community and has taken the
request under advisement. We hope to promulgate regulations in the future,
but are now focusing our limited resources on other DHS priorities.

就算是H1b那个律师说的也是错的，因为用AP回来无论如何都没有status。H1b用AP回来
只是有工作允许而已；还是没有status。

H1回来后重新I-129就能拿回status了，不过O1.....我不确定会不会引起485被拒

不过重新递交485是什么意思啊，有一个case在pending还可以再递交吗？

这个还挺risky的，要不就用EAD吧… 即使485悲剧，O1也是能在申请的吧，它允
许移民倾向吧？

O-1应该是允许dual intent的，但偏偏移民局没有明确说出来，这样就有了风险，稳妥
起见还是不要出境

to 2nd floor. USCIS thanked AILA for their suggestion but NEVER agreed to
that AILA's suggestion of including E and O visa for this purpose. In every
later response to inquiry since 2008, USCIS always said H/L/K/V officially,
and still ignore E/P/O visa in this category.

好吧，看来律师不靠谱！综合以上意见，目前O-1在启动AP时刻就应该永久作废了，回
来必须用EAD。如果不幸485悲剧，再申请O-1或者H-1也要看运气。。。
