去年11月面试的，主申请人绿卡已经拿到了。今天收到RFE，说因为党员inadmissible
，让我提交i601去waiver。
我出国（不交党费）快10年了。面试的时候基本没有问啥问题，就是信不信共产主义，
啥时候入党的，啥时候离开的等等，当时觉得应该没问题，律师也在场也觉得没问题。
。谁知道遇到这一遭。
现在请教大家，1）走601可能性大吗？个人感觉那个基本没戏。
2）还能继续argue超过5年这个吗？
3）还有啥出路吗？我有h1b

你请了律师，律师应该知道怎么做吧？是副申请人党员吗？是哪个office啊？我觉得先
argue吧，你都10年了。

听说有601过的，你为什么觉得没戏？党员的问题可大可小，io非要抓着不放，谁有没

我主要了解的少。从那个601要求的讲法，感觉要求很高，601是从人道主义角度出发的
。并且说一般的由于没有绿卡而造成的分居和生活改变，是不够601标准的。。。

OK. I think you can do 601 with them. But this is just a backup plan... 99%

应该不用601吧，再找个律师根据5年的规则好好写一下，估计老中律师比较懂

党员问题，符合条件的，可以考虑引述美国国务院对移民法相关条款的解读 9 FAM 40.
34 N6.4-2 如果是为了 obtaining, retaining, changing, or advancing in
employment, 则可以考虑符合 exception from inadmissibility. 此外，根据最高
法院的判例， 355 U.S. 115, 1957 (以及 9 FAM 40.34 N5.1)，如果是 non-
meaningful association, 也符合例外的条件。这些不需要退党五年。

The INA provides for two exceptions and one waiver for membership or
affiliation with the Communist Party; an exception for involuntary
membership, an exception for past membership, and a waiver for close family
members who have or had an affiliation with the Communist Party.
Additionally, there is a judicially created concept that affords relief for
non-meaningful associations with the Communist Party. An alien having a
connection to the Communist Party is not an absolute bar for admissibility.
Based on these categories for overcoming admissibility, the context and
extent of the membership or affiliation can make a difference.

面试的人是觉得党员inadmissible，让提交i601去waiver。但是不清楚他们是否知道
除了601 waiver之外（a waiver for close family members who have or had an
affiliation with the Communist Party. ），上面链接提到的two exceptions (an
exception for involuntary membership, an exception for past membership, )也
可以。找律师商量一下吧。
