Hi all,
I struggle for getting one extra week before my start date in my new company
because I want to let my child have a transfer time for his new daycare.
The thing is my current company will not allow me to use my annual leave and
they will revoke my H-1B immediately at my last day. And my new company's
lawyer barely answer my phone.
Is there any negociation time with my new company to get the one extra week
AND avoid the gap between two H-1B ? Does the gap means the time difference
in the paycheck date ? If it is, I guess I have no choice but move in the
weekend and begin to work on next Monday.

新公司的H1B批下来没有
批下来了就无所谓
啥时候上班跟新公司商量就是了
早晚一个礼拜根本没关系

拿到receipt了，还没拿到approval. 律师是一定要我拿到approval之后才能开始上班
的。虽然考古到很多人都是拿到收据就去上班的。可我现在这个（旧）公司的HR人说只
有等拿到approval之后才能上班的。新公司的律师惜字如金，也没有任何建议。
如果照楼上所说的，可以晚一周上班那是最好的。可我的问题是：假如我旧公司把我的
H1B给revoke了，而且我的新H1B批准也在revoke之前批准了。可我如果不在revoke的下
周一就上班的话，那是不是就存在所谓的gap呢？因为我旧公司意思是他们的paycheck
只能发到我的最后一天。
我就不清楚，这个所谓的H1B之间没有gap，是指pay date 没gap，还是pay check签发
的日期之间没gap.
我现在的理解是pay date之间没gap.如果是这样的话，我就只能这边周五辞职，下周一
就必须去新公司报道。因为我旧公司是一定会在我的最后一天给revoke掉我的H1B的，
那新公司那边有什么可商量的余地么？我觉得我现在只能就是周五辞职下周一就报道这
种了。要不然新公司即使同意让我晚去一个礼拜我也不敢呀。因为如果那样的话，我的
pay date不就该有一个星期的gap了么？那晚的一个礼拜没人pay我钱呀
真是弄不明白呀，那位仁兄有官方链接的给发个吧。或者谁能帮我解释一下也行呀。

别担心了，律师都是很没效率的很不理人的，但是你有了receipt就是合法的了，没有
gap之说。
借贴问下，当初你的律师拿到你的材料帮你准备H1B Transfer case到file一共用了多
久？
然后你从file给USCIS到收到他们的receipt等了多久？

想太多了
拿到receipt即可开始工作
当然你晚一段时间也可以
换工作之间一两个星期的GAP很常见
无数人宁肯不要钱在家歇俩礼拜再上班的
所以只要跟新公司商量上班日期就好了

回楼上的楼上，我的律师拿到材料到准备H1B Transfer case到file用了大概一个月的
时间。从file到receipt可能有一两个礼拜。原则上应该几天的，可我律师通知我很晚
的。所以我具体时间不太清楚。

讨教版主大人。我是觉得别人都不可能都周五辞，下周一就上班的。可所谓的gap到底
是什么呢？我想找个官方的说法然后再做决定呀。
我猜是很多人旧公司很nice，可以revoke他的旧h-1b在两个星期之后什么的。
要不然就是我理解的gap不对。

这么多人都已经说了，请你相信我们。有了receipt你在新公司的身份就合法了。旧公
司revoke你的h1b之前，你同时拥有两个工作身份。一般说gap的人，都是layoff然后来
不及找下家的。
现在h1b transfer从receipt到approval要四个月时间。
希望我解释清楚了。

是的,你的律师很不靠谱，下次介绍你一个律师人不错做事效率快。
一般先LCA,只要拿到基本信息律师当天就可以网上递交，7天等待过程基本就能弄完所
有后续材料，LCA一过就马上file USCIS了

我自己的经历是，只要新东家把H1B交上去，就可以去工作了，连receipt都不用等。
我的老东家在我辞职一个月后revoke h1b
新H1B在这个之后一个月才approve

我也觉得rotone你说的对。因为我细想了一下：要是按我的pay date的逻辑，就算周五
辞，下周一上班。那那个周末两天不也是gap么。最大的可能是两个paycheck的签发日
子不能有空隙。
我过我还是决定下周去骚扰一下我们公司的律师。看他们怎么说。
其实真是看律师了，我一个同事也走了，下家的律师还没file呢就说她可以去上班了。
我的律师是一定要等到电子的approval才让我去上班的。
我最烦这种较真的事了，不过为了确保一万还得继续较真。请不要拍我~~~~ 我是真心
求教滴

Feel so bad about my status.
Just want to update my case with you guys and need the suggestion again.
The lawyer told me that my H-1B VISA is a RFE case on April 4 and need my
pay stubs from Jan 29 to Mar 23. This is her fault because she did not let
me update my pay stubs when she filed the petition on March 23. She got my
pay stubs in February for the preparation.
But my current company pays us biweekly and has 2 weeks delay. That means
that I only can wait until April 8 to give pay stubs for the week of March
23. Meanwhile my current company's HR refused me to provide a employment
verification letter without a "last day" on it. If she can give this type of
letter on April 4th, I may get approval in earlier next week.
I asked the lawyer the gap in her mind. She does not want me to quit my
current job until she gets the electronic approval. So I cannot move even my
current company know that I am resigning.
My landlord makes the thing worse. She told me that I must to move out on
April 21 because she has someone to move in on May 1st. But before she told
me that I can stay as long as possible if I pay the rent.
Lucky, my supervisor sets a tempriory last day as “April 14” and allows me
to stay longer if I need to.
So right now, I cannot move because my attorney will consider the time
between the resign day to the day of electronic approval as a GAP. And I
need to know when I can move next week to my landlord.
Right now, if I cannot get any notice before April 13 (next Wednesday), I
have to postpone my last day to “April 21”
My question is "How Long a RFE case will take?" Anyone have an idea please
share with me. I will thank you very much for any valuable suggestion.

律师有点费劲儿
这么简单的H1B transfer还搞出这么多麻烦..
那就等到4月8号拿到paystubs再说吧
其实现在公司倒也不错了
提出辞职后还让你随便待多久
立马被要求走人的也不是没有过

Yes. I do appreicate my current supervisor. It really is great favor.
I just admit that there are too many selfish person in this country.
