现在的公司是一家印度的outsource company。
一个月前拿到了新公司的offer.之后我就去跟现在的公司确定last day. 公司规定是两
个月的notice period, if shorten, need to pay the company. 因为新公司急着要人
，所以我跟现在的公司商量并且确定了一个月的notice period, pay company one
month salary.之后我就去update 我的新公司，并且确定了那边的joining date.
就这样差不多过了3个多礼拜，上周拜三，我问hr， last day clearance 我需要做什
么。这时候，现在的公司才突然跟我讲，由于client 要求，公司要延长我的last day.
negotiate 了几天，我都是跟现在的公司说我最多可以延长一个礼拜（本来是打算休息
一下的）.可是公司一直坚持至少两个礼拜。上个拜五，见了公司的sales,跟hr, 居然
一直声称要不然我extend 两个礼拜，要不然不给我做clearnace. 谈不拢，后来居然单
方面的去系统里面把我的last day 改成了mid of june.
新公司的offer, 是我辛辛苦苦好不容易才拿到的。本来下个拜一，我就应该去新公司上班了。大家把我看看，我该怎么做啊。求bless.

但是不做clearance form，不是还没有终止合约吗？没有终止上一家的合约，可以去
下一家工作吗？
而且还有一个背景调查啊。

Is your job an at-will employment? Check your original offer letter and see
what it says.

2. Notice Period/ Separation:
Your employment with the Company can also be terminated either by the
Company or by you by
giving the other party two months advance notice. If the Company terminates
the employment and
decides to relieve you before the completion of the notice period, the ‘
Basic’ component of the salary
for the balance notice period would be paid to you. If at your request, the
Company agrees to relieve
you before serving the full notice period, you will be liable to pay the
Company the ‘Basic’
component of the salary for the balance notice period. However, please note
that accepting any such
early relieving request would be entirely at the discretion of the Company.
我就是不知道，最后一句， entirely at the discretion of the company, 是不是，
company 随时可以反悔之前的approval.

美国好像都是at-will？不做consulting这一行，第一次看到要向公司赔钱的合约，这
种合约有法律的约束力吗？
而且这个条款不全面，完全没有提如果公司不同意雇员提前终止合同怎么办？我估计你
走了最多也就是赔公司剩下几周的钱。
不过你也可以先试着跟新公司解释一下，在老公司有个交代，一般HM会理解的。

别怕，到时候走人，印度公司吓唬你，我工作过的公司都是2星期notice.
如果他们解聘你，才不会给你2month notice.
新公司如果要reference,就找几个好朋友。

company 随时可以反悔之前的approval.
绝对不是。公司可以一开始就不接受，但一旦接受，再想改就需要你的同意了。

据我所知，这种合同是不合法的。 It is not enforceable in court.

我从来就没有同意过。公司的sales, 跟HR很harsh，觉得自己最了不起，公司里的
devleoper都欠
他们似的。上个拜五，一下子就说要revert back the approval.不知道是不是真的他
们说了算。
可是现在我应该怎么跟他们讲呢， it might not be proper once the company
approved
and confirmed my last day, and later wanna to change.
如果他们就是说他们说了算，不放我走，那怎么办哪。即使我去找legal agencies, 也
需要时间吧。

先走了再说，他们要告你你也不要怕，都是2 weeks notice的，他们告不赢的
by the way, they will not sue you most likely.

Approval是书面的吗？如果是，那么你不在乎他们的反应的话，尽可以说：go f*k
yourself，然后扬长而去。即便不是书面的，你不去上班他们又能拿你怎样？无故旷工
也不过就是扣发工资吗。你的合同里面大概没有这方面的增加赔偿条款。所以根本没什
么必要怕他们。

但是我担心我的new employer 可能不愿意有这些情况吧。而且还要做background
check的。一
个月前我已经放了现在这个印度manager的名字上去。

background是看你有没有犯罪记录。你放这个manager名字是给reference吧？都已经录
用了，还怕reference反悔？

这边的情况好像不太一样啊。我确实是在background check (first advantage）的
form里面
填reference.

这个公司上个拜五还直接去system改了record, 把我的last day 改成了Jun 16, 2011.
他们一直说因为client 要留我到mid of Jun, 所以公司要extend 我的last day. 但是
这个last day, 公司确定了之后，last minute,还可以说该就该吗？
而且，我跟client 公司谈过，他们只是要这个印度公司找一个replacement, 不care
我什么时候走。可是，印度的这几个人就一直坚持说，是client request, 所以要hold
我。
可是，要extend 我4 个礼拜，我的new employer 肯定不会同意的。

合同本来就是不合法的. Employment should be at will. Let them fuck themself.
If you are still afraid, keep all the evidence and find a lawyer. Let the
lawyer send them a letter and screw them up.

You don't have to show up on Monday. The employer can't do anything to harm
you.

1. Print out /forward all the documents about the time you requested to quit
, the time they approved, any thing you think you should keep.
2. Go to the new company to work as you requested.
In USA, they can't stop you. They may sue you if they think that you breach
the contract, then you need to find a lawyer -- which you will win in this
case.
Nothing is more important than your own human right, forget the client or
your company. If you don't protect yourself, nobody will. Even you give in,
You will lose your job right after. So don't give in, just leave.

BTW, don't tell your new company about this. You may scare them away.
Most likely, nothing will happen, and you can move on. In the worst case,
they did find it out, then you explain what happened in a clean , easy
understanding way. No emotion please.

要是人那么做，我就从明天到我自己决定的那天都不去了说家里有事要请假而且也
不赔钱
但我不会把前manager写在reference
还有就是要不协商下
给他们晚上做按小时受双分的钱

昨天google 了一下，发现这家公司HCL，原来很经常做这么不要脸的事。 HCL有很多
record, 欺负在印度的员工. 不懂Singapore，HCL 是不是也有权利这么无法无天。
我简直要被气炸了。 2天以后就是我的joining day 了，这个烂公司还在跟我讲说不
确定什么时候可以release我。他有这个权利，确定了一个月了，又last minute 改吗
？！
