theoretically, if current company withdraw the pending H1, or H1 gets denied
, the cap-gap stops (=F1 ends). So if the new H1 filed when you are still in
cap-gap, your stay should be fine during new H1 pending, but may be you
should not work since your OPT already expired before this H1 received date.
There's no official interpretation on this, and it's just my
interpretation.

谢谢指点啊！问过两个律师了，都说这个情况比较少见，没有清楚的规定，只能自担风
险。没办法，估计offer黄了，新公司不会等到十月份的。

加急现在pending的H1B
批准之后就可以transfer。。
