if the new H1B I-94 is attached with the approval notice, you are fine. If
no I94 on the 10-1 effective I-797, it means USCIS don't allow the gap.

I heard that I have 2 options:
1 apply for the new H1B
2 transfer non-cap H1B to cap-H1B.
which situation is your example?
